ZONING BOARD OF
APPEALS
March 20, 2019
The Town of Macedon Zoning Board of Appeals meeting was held on
Wednesday, March 20, 2019, 7:30 p.m., at the Town Complex, 32 Main Street,
Macedon, NY. Present were Chairman Warren
Jeffries and Board members Deborah McEwen, Mike Mosher, Ronald Santovito, and Brian Frey.
Also present was Town Councilman Bruce Babcock and Temporary Board Clerk
Sandy Pagano. Absent was Town Engineer/CEO Scott Allen.
Chairman Jeffries called the meeting to order at 7:30 p.m. He then explained the purpose for which the
Board serves and read the Legal Notice as it appeared in the Times of Wayne
County Newspaper.
PUBLIC HEARING:
Z-01-19 Hogan Enterprises 1934 Route
31 Area Variance Section 135-39 Fence Height, Front and Sides Mark Haley, Monroe Road Ways, was present to address the Board on
behalf of the application. Discussion of purpose of Fence. Any
buildings on property now, No buildings no purpose to put up a building
currently.

these variances. The public hearing was

135-190(A,B,&C)- Number of signs & size of signs
Michael Newcomb was present to address the Board
on behalf of the application. Process of building a new convenience store
having Taco Bell included since it is a corner lot, they are requesting more
signs.

BOARD DISCUSSION:
Z-01-19 Hogan Enterprises 1934 Route 31 Area Variance
Section 135-39 Fence Height, Front and Sides A motion was made by Ronald Santovito,
seconded by Brian Frey, to approve the variance as submitted in the application.
Board members discussed may want to update the code it is a
commercial area a couple 100 feet off the Highway it will blend in with the
area
The five factors were reviewed:
There would be no undesirable change in the character of the
neighborhood; benefit sought could not be achieved by another method; variance
was not substantial; there would be no adverse impact on the physical or
environmental conditions in the neighborhood; difficulty is it self-created Yes
Roll Vote: Mosher yes; Santovito yes; McEwen yes; Frey yes; Jeffries
yes. Therefore, this variance was
granted

seconded by Debbie McEwen, to postpone until the next meeting.

denied.

made by Brian Frey, seconded by Deborah McEwen.
