The Town of Macedon
Zoning Board of Appeals meeting was held on Wednesday, May 16, 2018, 7:30 p.m.,
at the Town Complex, 32 Main Street, Macedon, NY. Present were Chairman Warren Jeffries and
Board members Brian Frey, Ronald Santovito, and Mike
Mosher. Also present were Town
Councilman Sandy Pagano and Board Clerk Brandi Schutt. Absent was Town Engineer/CEO Scott Allen.
Chairman Jeffries
called the meeting to order at 7:30 p.m.
He then explained the purpose for which the Board serves and read the
Legal Notice as it appeared in the Times.
PUBLIC
HEARING:
Z-01-18 – Oehlbeck – 1344 Alderman Road
– Area Variance – Section 135-61-B-3 – Accessory structure larger than
principal structure – Nathan Oehlbeck was present to address the Board on behalf of the
application. He explained that he had a public hearing last year for this
variance but did not pull the permit in time. He stated that the only thing
that has changed is that he removed a door and now will have two bigger doors
instead of three.

Wayne County Planning Board – Returned to the Town to be handled as a
local matter

Planning Board – Positive Referral

Town Board – No comment
•
SEQR – Not required at Appeals level
There was no one
else to speak for or against the granting of these variances. The public hearing was closed at 7:39 p.m.
Z-02-18 – Wilson – 1168 Victor Road – Area Variance –
Section 135-61-B5 – Accessory structure in side yard – Josh Wilson was present to address the Board on
behalf of the application. He explained that he has put up a greenhouse that he
would like to extend into his side yard. He addressed questions from the board
stating that there is not much room in his back yard and purchasing land from
the neighbor is not an option. He also mentioned the greenhouse will not be a
permanent structure.

DISCUSSION:
Z-01-18 – Oehlbeck – 1344 Alderman Road

principal structure – A motion
was made by Ronald Santovito, seconded by Mike Mosher,
to approve the variance as submitted in the application.
The five factors
were previously reviewed at the meeting on June 21, 2017.
Roll Vote: Santovito – yes;
Frey – yes; Mosher – yes; Jeffries – yes.
Therefore, this variance was granted.
Z-02-18 – Wilson – 1168 Victor Road – Area Variance –
Section 135-61-B5 – Accessory structure in side yard – A motion was made by Brian Frey, seconded by Ronald
Santovito, to approve the variance as submitted in
the application.
The five factors
were reviewed: There would be no
undesirable change in the character of the neighborhood; benefit sought could
not be achieved by another method; variance is not substantial; there would be
no adverse impact on the physical or environmental conditions in the
neighborhood; difficulty was not self-created.
Roll Vote: Santovito – yes;
Frey – yes; Mosher – yes; Jeffries – yes.
Therefore, this variance was granted.
MINUTES:
A motion to approve
the 12-20-17 minutes was made by Ronald Santovito,
seconded by Brian Frey. All in favor; minutes
approved.

A motion to adjourn
the meeting was made by Mike Mosher, seconded by Ronald Santovito. All in favor; meeting adjourned at 7:56 p.m.
