ZONING BOARD OF APPEALS

April 19, 2017

 

 

The Town of Macedon Zoning Board of Appeals meeting was held on Wednesday, April 19, 2017, 7:30 p.m., at the Town Complex, 32 Main Street, Macedon, NY.  Present were Chairman Warren Jeffries and Board members Carl Eligh, Brian Frey, Anthony Rosati and Ronald Santovito.  Also present were Town Councilman Bruce Babcock and Board Clerk Susan Bush.  Absent was Town Engineer/CEO Scott Allen.

 

Chairman Jeffries called the meeting to order at 7:32 p.m.  He then explained the purpose for which the Board serves and read the Legal Notice as it appeared in the Times.

 

PUBLIC HEARING:

 

Z-01-17 – SGA Design Group (Walmart) – 425 Route 31 – Area Variance – Sections 135-190-A & C – Number & size of signs – Stephanie Minguez of SGA Design Group was present to address the Board.  Ms. Minguez explained that Walm art is adding a new on-line grocery order/pickup service and would like an additional building-mounted sign to direct customers to the appropriate pickup area.  Walmart will be building an overhead canopy on the east side of the store to accommodate six (6) parking stalls for order pick up.  When ordering on-line, customers get a scheduled time to pick up their orders.  The customers park their vehicles in the designated pickup stalls, use their cell phones to call into the store, and the orders are delivered to the customers’ vehicles.  The service would be available 8:00 a.m. to 8:00 p.m.

 

The proposed sign will read “Pickup” with the Walmart “spark” logo.  It will be 66 sq. ft., internally lit, have the same font/colors as existing signs, and will be mounted on the east end of the building.  Ms. Minguez felt the total sign coverage for Walmart with this addition would not be disproportionate given the size of the building.  She indicated Macedon Marketplace’s sign coverage was 6.5% of the building front; Vella Bath plaza was 8% sign coverage; and, Walmart’s coverage would be 2.9% with the new sign.

·        Planning Board – Positive referral

·        Town Board – Representative supported the signage

·        SEQR – Not required at Appeals level

 

There was no one else to speak for or against the granting of these variances.  The public hearing was closed at 7:50 p.m.

 

BOARD DISCUSSION:

 

Z-01-17 – SGA Design Group (Walmart) – 425 Route 31 – Area Variance – Sections 135-190-A & C – Number & size of signs – A motion was made by Carl Eligh, seconded by Ron Santovito, to approve the variances as submitted in the application.  Board members felt on-line purchasing was becoming popular with consumers and having the pickup area identified was beneficial.

 

The five factors were reviewed:  There would be no undesirable change in the character of the neighborhood; benefit sought could not be achieved by another method; variances were not substantial; there would be no adverse impact on the physical or environmental conditions in the neighborhood; difficulty was self-created.

 

Roll Vote:  Eligh – yes; Frey – yes; Rosati – yes; Santovito – yes; Jeffries – yes.  Therefore, these variances are granted.

 

MINUTES:

 

A motion to approve the 10-19-16 minutes was made by Carl Eligh, seconded by Tony Rosati.  All in favor; minutes approved.

 

ADJOURNMENT:

 

A motion to adjourn the meeting was made by Carl Eligh, seconded by Tony Rosati.  All in favor; meeting adjourned at 7:56 p.m.
