ZONING BOARD OF APPEALS
August 17, 2016
The Town of Macedon Zoning Board of Appeals meeting was held on Wednesday, August 17, 2016, 7:30 p.m., at the Town Complex, 32 Main Street, Macedon, NY. Present were Chairman Warren Jeffries and Board members Brian Frey, Anthony Rosati and Ronald Santovito. Also present were Town Councilman Bruce Babcock and Board Clerk Susan Bush. Absent were Carl Eligh and Town Engineer/CEO Scott Allen.
Chairman Jeffries called the meeting to order at 7:31 p.m. He then explained the purpose for which the Board serves and read the Legal Notice as it appeared in the Times.
PUBLIC HEARING:
Z-07-16 Stone 2292 Centreview Trail Area Variance Sections 135-61-B-3, 4, 5 & Schedule I Size, height & location of accessory structure (pole barn) Applicant Mark Stone was present to address the Board. He would like to build a pole barn that: Exceeds the square footage of his house by 480 sq. ft.; is taller than allowed by Code (35 ft. vs. 24 ft.); is placed in the side yard vs. the rear yard; and, would be 5 ft. from the property line vs. 15 ft. required. He explained this will be a two-story barn, and the height is necessary to accommodate RV storage on the first floor with a family recreational area on the second floor. The proposed site of the barn would allow more room for vehicles to turn around and more area to pile snow in the winter. The location of leach lines and the slope of the land in the rear yard are also factors. Moving the barn forward to the side yard means less excavation. Mr. Stone explained he recently purchased a small slice of property from the adjoining parcel (vacant land) in order to have a place to put the barn. He stated there would be no business or commercial use of the barn. It will be used for storage of personal items/vehicles and family recreation.
· Town Board Representative questioned whether the barn could be moved farther back
on the property.
· Planning Board Not opposed to the size or height of the barn; however, they felt it was
located too close to the property line. The barn could be moved to the back and rotated
90° to eliminate the two variances for side yard location and setback from the property line.
· Wayne County Planning Board Referral not required
· SEQR Not required at Appeals level
Letters of support for this application were received from the residents at 2329 Centreview Trail and 2328 Centreview Trail.
There was no one else present to speak for or against the granting of these variances. The public hearing was closed at 7:52 p.m.
