TOWN OF MACEDON
ZONING BOARD OF APPEALS
March 20, 2013
The
Town of Macedon Zoning Board of Appeals meeting was held on Wednesday, March
20, 2013, 7:30 p.m., at the Town Complex, 32 Main Street, Macedon, NY. Present were Chairman Warren Jeffries and
members Aaron Cook, Carl Eligh, John Gravino and Ronald Santovito. Also present was Board Clerk Susan Bush. Absent were Town Councilwoman Sandy Pagano
and Code Enforcement Officer Scott Allen.

Jeffries called the meeting to order at 7:28 p.m. He then explained the purpose for which the
Board serves and read the Legal Notice as it appeared in the Times.
PUBLIC HEARING:
Z-01-13 Switzer 1087 Alderman
Road Area Variance Sections
135 Schedule I & 135-37 One-lot realty subdivision creating a
non-conforming lot Applicant Paul Switzer and Engineer Don Lewis of AEY were
present to address the Board. Mr. Lewis
explained that the applicant originally owned two adjoining lots of .567 acres (with
residence) and 3.197 acres (vacant land) and merged the two into one parcel
several years ago. Anticipating sale of
the property, Mr. Switzer would like to re-subdivide the property along the
original lines, thus creating a non-conforming lot for the residence under the
current zoning standards. Mr. Lewis
stated that this was a conforming lot at the time the house was constructed;
there are other houses on the street with smaller lots than the one proposed by
the applicant; and, trying to meet the current Code requirements for the house
lot would create an irregular parcel with a long flag in the rear. Board members questioned other possible lot
designs such as increasing the frontage of the house lot so that it would
conform to the Zoning Code without a flag.

should be accomplished in a manner which would create two conforming lots. A larger size lot for the existing house
would also provide room
for future expansion of the septic system.

Planning Board No intermunicipal or countywide
impact with the following comments: (1)
Consideration should be given to modifying the proposed subdivision in an attempt
to have both lots conform with Macedon Code; (2) The proposed lots should be configured
with enough area to contain an existing and/or construct a new septic system that
will meet NYS Dept. of Health regulations; (3) The proposed lots should be
configured with enough area to contain an existing and/or construct a new driveway
that will meet AASHTO recommendations for sight distance; and, (4) The hardship
criteria that are required to grant an area variance be substantiated at the
local level. WCPB recommended referral be
returned to the Town to be handled as a local matter.

variances.

motion to table the discussion was made by John Gravino,
seconded by Carl Eligh. All in favor; motion approved.
MINUTES:
A
motion was made by Carl Eligh, seconded by Ron Santovito, to amend the attendance roll noted in the
12-19-12 minutes to indicate member John Gravino was
absent and then to approve the minutes as amended. All in favor; minutes approved as amended.

motion to adjourn the meeting was made by John Gravino,
seconded by Aaron Cook. All in favor;
meeting adjourned at 7:50 p.m.
