ZONING BOARD OF APPEALS

January 18, 2012

 

 

The Town of Macedon Zoning Board of Appeals meeting was held on Wednesday, January 18, 2012, 7:30 p.m., at the Town Complex, 32 Main Street, Macedon, NY.  Present were Chairman Warren Jeffries, members Aaron Cook, Carl Eligh, John Gravino and Ronald Santovito.  Also present were Town Councilwoman Sandy Pagano and Board Clerk Susan Bush.  Absent was Code Enforcement Officer Aron Thompson.

 

Mr. Jeffries called the meeting to order at 7:30 p.m.  He then explained the purpose for which this Board serves and read the Legal Notice as it appeared in the Times.

 

PUBLIC HEARING:

 

Z-09-11 – Infinite Audio – 1116 Route 31 – Area Variance – Section 135-190-A – Number of signs – James Beckenbach, owner of Infinite Audio, was present to address the Board regarding this variance request for three (3) signs vs. two (2) allowed by Code.  He is proposing two (2) building-mounted signs (Infinite Audio & Wireless World), along with an existing pylon sign.  The pylon (for a previous gas station) will be resurfaced for Infinite Audio.  Building-mounted signs will be located in the front peaks over the entrance doors.  Signs will be internally illuminated, probably 24 hrs./7 days a week.  There will be additional external lighting around the doors and on the east end of the building (no spotlights).  Another family member was present to support Mr. Beckenbach’s request.

  • Planning Board – Positive referral
  • SEQR – Not required at Appeals level
  • Town Board – No comment

 

There was no one else present to speak for or against the granting of this variance.

 

BOARD DISCUSSION:

 

Z-09-11 – Infinite Audio – 1116 Route 31 – Area Variance – Section 135-190-A – Number of signs – A motion was made by John Gravino, seconded by Carl Eligh, to grant the variance as presented in the application.

 

The five factors were reviewed:  No undesirable change in the neighborhood; variance was not substantial; no adverse effects on the physical or environmental conditions; difficulty was self created.

 

Roll Vote:  Cook – yes; Eligh – yes; Gravino – yes; Santovito – yes; Jeffries – yes.  Therefore, this variance is granted.

 

MINUTES:

 

A motion to approve the 11-16-11 minutes was made by John Gravino, seconded by Aaron Cook.  All in favor; minutes approved.

 

ADJOURNMENT:

 

A motion to adjourn the meeting was made by John Gravino, seconded by Aaron Cook.  All in favor; meeting adjourned at 7:45 p.m.
