ZONING BOARD OF APPEALS

March 16, 2011

 

 

The Town of Macedon Zoning Board of Appeals meeting was held on Wednesday, March 16, 2011, 7:30 p.m., at theTown Complex, 32 Main Street, Macedon, NY.  Present were Chairman Warren Jeffries, members Aaron Cook, Carl Eligh and Ronald Santovito.  Also present were Councilwoman Sandy Pagano and Board Clerk Susan Bush.  Absent were John Gravino and Code Enforcement Officer Michael Nelson.

 

Mr. Jeffries called the meeting to order at 7:30 p.m.  He then explained the purpose for which this Board serves and read the Legal Notice as it appeared in the Times.

 

PUBLIC HEARING:

 

Z-01-11 – Knobel – 1651 Walworth Road – Area Variance – Section 135-61-B-3 – Accessory structure larger than primary structure – Applicant Todd Knobel was present to address the Board regarding this request.  He would like to build a barn to store personal items and vehicles that are currently parked outside (boat/trailer, truck with snowmobile trailer, vintage car, etc.).  The building would not be used for any commercial purpose.  Board members questioned the distance from the building to the property lines.  Applicant stated he will meet the required setback distance (15 ft. side and rear).

 

  • Wayne County Planning Board – No intermunicipal or countywide impact;

returned to the Town to be handled as a local matter.

  • Town Board – No comments
  • SEQR – Not required at Appeals level

 

There was no one else present to speak for or against the granting of this variance.

 

BOARD DISCUSSION:

 

Z-01-11 – Knobel – 1651 Walworth Road – Area Variance – Section 135-61-B-3 – Accessory structure larger than primary structure – A motion was made by Carl Eligh, seconded by Ron Santovito, to grant this variance as submitted.  Board members noted that similar variances have been granted in the past.  Also, there are comparable barns in the applicant’s neighborhood.

 

The five factors were reviewed:  No undesirable change in the character of the neighborhood; variance requested is not substantial; no adverse environmental impact.

 

Roll Vote:  Cook – yes; Eligh – yes; Gravino – absent; Santovito – yes; Jeffries – yes.  Therefore, this variance is granted.

 

 

MINUTES:

 

A motion was made by Carl Eligh, seconded by Aaron Cook, to approve the 12-15-10 minutes.  All in favor; minutes approved.

 

 

ADJOURNMENT:

 

A motion to adjourn was made by Warren Jeffries, seconded by Carl Eligh.  All in favor; meeting adjourned at 7:40 p.m.
