ZONING BOARD OF APPEALS
April 22, 2009
The Town of Macedon Zoning Board
of Appeals meeting was held on Wednesday, April 22, 2009, at the Town Complex, 32 Main Street, Macedon,
NY. Present were Chairman Warren
Jeffries, members Carl Eligh, John
Gravino and Ronald Santovito. Also
present were Town Councilman David McEwen
and Board Clerk Susan Bush. Absent was Charles Packard and Code Enforcement Officer Michael
Nelson.
Mr. Jeffries called the meeting
to order at 7:33 p.m. He then explained
the purpose for which this Board serves and read the Legal Notice as it
appeared in the Times.
PUBLIC HEARING:
Z-03-09 ABVI/Goodwill 1635 North Wilson Road Area
Variance Section 135-190-A Number of signs Present on behalf of the
applicant were Andy Hart and Jeff
Bush of Bergmann Associates and Tim Giarusso, Sr.
Vice President of ABVI/Goodwill. Mr.
Hart gave a brief overview of the project.
Site plan approval was granted in 2008 and building construction is now
underway. Site is located on North Wilson Road
and has limited visibility from Route 31.
The variance is for two (2) additional signs beyond two (2) allowed by Code. The four (4) signs would be: A main sign over the front door; a
Donations sign on the front of the building indicating the donation drop-off
area; a sign on the south side of the building to increase visibility from
Route 31; and, a pylon sign at the entrance from North Wilson Road. The sign over the front door will be
externally lit, the other three will be internally
lit. Signs will not be illuminated
during the overnight hours. All signs
will be within the height and square footage requirements. Applicant feels these signs fit within the
character of other signs along Route 31 such as WalMart
& Lowes.

Section 135-190-A Number of signs A motion to grant this variance as
submitted was made by John Gravino, seconded by Carl Eligh. Chairman Jeffries felt the distance from
Route 31 was an extenuating circumstance for this applicant.
The five factors were
reviewed. Board members felt this would
not cause a change in the neighborhood, the variance requested was not
substantial, and there would be no adverse environmental effect.
Roll Vote: Eligh yes;
Gravino yes; Packard absent; Santovito yes; Jeffries yes. Therefore, this variance is granted.

minutes was made by John Gravino, seconded by Ron
Santovito. All in
favor; minutes approved.
ADJOURNMENT:
A motion to adjourn was made by Ron Santovito, seconded by Carl Eligh. All in favor; meeting adjourned at 7:51 p.m.
