ZONING BOARD OF APPEALS

February 18, 2009

 

 

The Town of Macedon Zoning Board of Appeals meeting was held on Wednesday, February 18, 2009, at the Town Complex, 32 Main Street, Macedon, NY.  Present were Chairman Warren Jeffries, members Carl Eligh, John Gravino, Charles Packard and Ronald Santovito.  Also present were Town Councilman David McEwen, Code Enforcement Officer Michael Nelson and Board Clerk Susan Bush.

 

Mr. Jeffries called the meeting to order at 7:30 p.m.  He then explained the purpose for which this Board serves and read the Legal Notice as it appeared in the Times.

 

PUBLIC HEARINGS:

 

Z-01-09 – Ontrac/Bob James – 185 Route 31F – Area Variance – Section 135-190-A – Number of signs – Ron Perry of Ontrac Equipment was present to explain this request.  They would like to add another 3’ x 6’ product panel to the existing free-standing sign at the road.  There is adequate room to mount this panel on the existing framework; sign would be double sided and illuminated on both sides.

 

·        Wayne County Planning Board – No opinion rendered; WCPB did

not meet within the 30-day time limit for referrals.

·        Planning Board – Positive referral

·        Town Board – Agreed with the Planning Board recommendation

·        SEQR – Not required at Appeals level

 

There was no one else present to speak for or against the granting of this variance.

 

Z-06-08 – Prime Development – 1241 Route 31 – Area Variance – Sections 135-190-A & C, 135-191-B – Number & size of signs – Kevin Hartson of Prime Development was present to explain requested sign variances for a new convenience store-laundromat-McDonald’s.  After Planning Board review, a revised proposal (01-22-09) was submitted, reducing the amount of variance requested in the original proposal (12-17-08).  The McDonald’s arches were removed from the enter/exit signs and two (2) sets of enter/exit signs were eliminated.  The monument sign was reconfigured, relocating all sign panels between the brick pillars with the McDonald’s arches on top.  Mr. Hartson stated the electronic message board would not flash or scroll with the message changed twice daily, once for breakfast and then again for lunch.  Monument sign meets Code height requirement.

·        Planning Board – Positive referral with the recommendation the

electronic message board on the monument sign would not

automatically change or scroll.

·        Town Board – Concurred with the Planning Board recommendation

·        SEQR – Not required at Appeals level

 

There was no one else present to speak for or against the granting of these variances.

 

BOARD DISCUSSION:

 

Z-01-09 – Ontrac/Bob James – 185 Route 31F – Area Variance – Section 135-190-A – Number of signs – A motion to grant this variance per the application was made by Carl Eligh, seconded by Charles Packard.  The five factors were reviewed.  Members felt there would be no undesirable change in the neighborhood, the variance requested was not substantial and would have no adverse environmental effect.

 

Roll Vote:  Eligh – yes; Gravino – yes; Packard – yes; Santovito – yes; Jeffries – yes.  Therefore, this variance is granted.

 

Z-06-08 – Prime Development – 1241 Route 31 – Area Variance – Sections 135-190-A & C, 135-191-B – Number & size of signs – A motion to table the discussion until the March 18, 2009 meeting was made by John Gravino, seconded by Charles Packard.  All in favor; motion carried.

 

MINUTES:

 

A motion to approve the 12-17-08 minutes was made by Carl Eligh, seconded by Ron Santovito.  All in favor; minutes approved.

 

ADJOURNMENT:

 

A motion to adjourn was made by Ron Santovito, seconded by Carl Eligh.  All in favor; meeting adjourned at 8:10 p.m.
