ZONING BOARD OF
APPEALS
March 15, 2006
The Town of Macedon Zoning Board of Appeals meeting was held
on Wednesday, March 15, 2006, at the Town Complex, 32 Main Street, Macedon,
NY. Present were Chairman Warren Jeffries and
members Carl Eligh, John Gravino,
Charles Packard and Ron Santovito. Also present were Town Engineer Scott Allen
and Councilman David McEwen.
Mr. Jeffries called the meeting to order at 7:30 p.m. He then explained the purpose for which this
board serves and read the Legal Notice as it appeared in the Times.
PUBLIC HEARING:
Z-01-06 – Kuntz – 1129 Wilson Road
– Area Variance – Section 135 Attach. 1.1 – Front & side setbacks – Ted
& Kathy Kuntz were present to explain this application. They would like to build a new, two-car
attached garage and convert their present garage into a family room. New garage would be in front of existing
garage, resulting in a requested front setback variance of 12 ft. and a side
setback variance of 13 ft. A portion of
the driveway will be relocated to meet the new garage. Swimming pool in the rear yard eliminates
that area, and adding to the end of the house would necessitate a larger side
setback variance. A letter of support
was submitted from neighbors at 1103, 1221 & 1142 Wilson Road. There was no one else present to speak for or
against this application.

BOARD DISCUSSION:
Z-01-06 – Kuntz – 1129 Wilson Road
– Area Variance – Section 135 Attach. 1.1 – Front & side setbacks – Motion
made by Carl Eligh, seconded by Charles Packard, to
grant these variances per application.
Mr. Eligh felt neighboring properties had the
same or shorter front setbacks, and that this project would fit the character
of the neighborhood. It was also noted
the variance would be lessened by this garage placement vs. adding to the end
of the house. The five factors were
reviewed.
Roll Vote: Eligh – yes; Gravino – no;
Packard – yes; Santovito – yes; Jeffries – yes. Therefore, these variances are granted.

by John Gravino, seconded by Carl Eligh. All in favor; minutes approved.
