ZONING BOARD OF APPEALS
January 12, 2005
The Town of Macedon Zoning Board of Appeals meeting was held on Wednesday, January 12, 2005, at the Town Complex, 32 Main Street, Macedon, NY. Present were Chairman Warren Jeffries, members Carl Eligh, John Gravino and Ronald Santovito. Also present was Town Engineer Scott Allen. Absent were Charles Packard and Town Councilman David Maul.
Mr. Jeffries called the meeting to order at 7:31 p.m. He then explained the purpose for which this Board serves and read the Legal Notice as it appeared in the Times.
PUBLIC HEARING:
Z-16-04 – Flaherty's Three Flags Inn – 113 Route 31 – Area Variance – Sections 135-189-K, 135-190-E, 135-190-F – Size & location of free-standing sign – Timothy Flaherty was present to explain his application. They would like to erect a monument sign for more visibility for the business. Mr. Flaherty stated the restaurant expansion at Eastview Mall in late 2003 caused a 20% decline in their business, which has taken a year to regain. By adding this sign they hope to combat a similar situation with future commercial expansion along Route 31. The sign will be located 75 ft. from the western property border on the right-of-way line. There will be green space between the sign and highway pavement. Placement will not obstruct line of sight for vehicles entering Route 31 from Flaherty's parking lot. Mr. Flaherty also cited signs for Shamrock Mobile Home Park and Miceli's Restaurant as being closer to the highway. Construction will be 4"x4" wooden posts with a planter around the base to mask light fixtures. Both John Gravino and Carl Eligh had visited Flaherty's parking lot and felt the sign should not be a problem. Mr. Jeffries stated a variance had been granted for the Miceli's sign with conditions on construction. There was no one else present to speak for or against the granting of these variances.

BOARD DISCUSSION:
Z-16-04 – Flaherty's Three Flags Inn – 113 Route 31 – Area Variance – Sections 135-189-K, 135-190-E, 135-190-F – Size & location of free-standing sign – Motion made by John Gravino, seconded by Carl Eligh, to grant these variances. The five factors were reviewed.
Roll Vote: Eligh – yes; Gravino – yes; Santovito – yes; Jeffries – yes. Therefore, these variances are granted.
ADDITIONAL BUSINESS:
Mr. Jeffries advised the Board members he had received notification the Planning Board had declared itself lead agency for the WalMart SEQR. Members had no objections.
Notice of a January 19th meeting regarding farm/farming laws has been received from Ora Rothfuss, Ag. Dev. Specialist. Town Engineer Scott Allen and Planning Board Chairman Doug Allen will be attending.
