ZONING BOARD OF APPEALS
October 13, 2004
The Town of Macedon Zoning Board of Appeals meeting was held on Wednesday, October 13, 2004, at the Town Complex, 32 Main Street, Macedon, NY. Present were Chairman Warren Jeffries, members Carl Eligh, John Gravino, Charles Packard and Ronald Santovito. Also present was Councilman David Maul. Absent was Town Engineer Scott Allen.
Mr. Jeffries called the meeting to order at 7:31 p.m. He then explained the purpose for which this Board serves and read the Legal Notice as it appeared in the Times.
PUBLIC HEARING:
Z-14-04 – Hilton – Walworth Road – Area Variance – Section 135-47 – New single-family residence without required garage – Jacob & Kelly Hilton were present to explain their application. Kelly Hilton explained it would be an extreme financial hardship to construct a garage in addition to a house large enough (1260 sq. ft.) to accommodate their growing family. They would use a barn on the adjacent property, owned by Mr. Hilton's father, as a garage for their vehicles. If the variance is not granted, the Hiltons stated they would have to reduce the size of the house to stay within their budget. John Gravino voiced concerns regarding completion of the garage if postponed (ownership could change) and future construction costs would be substantially higher. Karen Meyer, 2965 Walworth Road, the closest "non-related" neighbor, spoke in support of this application. She felt the Hiltons have strong family and community values and would complete the project as promised. A letter of support from Paul & Karen Meyer was also presented to the Board. There was no one else present to speak for or against the granting of this variance.
Planning Board – Negative referral – An unfavorable precedent would be set
Wayne County Planning Board – No intermunicipal or countywide impact
Town Board – An unfavorable precedent would be set; however, this does not
reflect upon the character of the applicants. Town would have no recourse
if garage is not built within specified time
SEQR – Not required
BOARD DISCUSSION:
Z-14-04 – Hilton – Walworth Road – Area Variance – Section 135-47 – New single-family residence without required garage – Motion made by John Gravino, seconded by Charles Packard, to deny the granting of this variance. John Gravino and Charles Packard stated this would be an unfavorable precedent should the variance be granted. The five factors were reviewed.
Roll Vote: Eligh – no; Gravino – yes; Packard – yes; Santovito – yes; Jeffries – yes. Therefore, this variance is denied.

Motion made by Charles Packard, seconded by John Gravino, to approve the 9-8-04 minutes. All in favor; minutes approved.
