ZONING BOARD OF APPEALS

May 12, 2004

 

The Town of Macedon Zoning Board of Appeals meeting was held on Wednesday, May 12, 2004, at the Town Complex, 32 Main Street, Macedon, NY. Present were Chairman Warren Jeffries and members Carl Eligh, John Gravino, Charles Packard and Ronald Santovito. Absent were Councilman David Maul and Town Engineer Scott Allen.

Mr. Jeffries called the meeting to order at 7:32 p.m. He then explained the purpose for which this Board serves and read the Legal Notice as it appeared in the Times.

 

PUBLIC HEARING:

Z-04-04 – VanEtten – 2157 Barnes Road/Area Variance – Section 135-61-A – Garage larger than allowed by Code – Joanne VanEtten was present to explain this application. They are proposing a 1200 sq. ft. garage as opposed to the 800 sq. ft. allowed by the Code. The additional space is needed for storage of a boat, pop-up camper, motorcycle and other personal items. No commercial use will be made of the space. A building permit has been issued for their home (2,898 sq. ft.) with a standard two-car garage. If this variance is approved, the building plans will be revised to reflect the larger garage. There was no one else present to speak for or against the granting of this variance.

The public hearing was then closed.

BOARD DISCUSSION:

Z-04-04 – VanEtten – 2157 Barnes Road/Area Variance – Section 135-61-A – Garage larger than allowed by Code – Motion made by John Gravino, seconded by Charles Packard, to grant this variance according to the plans submitted. Mr. Jeffries noted this is an exception due to the location of the house (approximately 800 ft. back from the road), and the garage will be end-loaded so the doors would not visible from the road. It was also noted that two neighboring houses have 3-car garages and there are several barns in the area. The five factors were reviewed.

Roll Vote: Eligh – yes; Gravino – yes; Packard – yes; Santovito – yes; Jeffries – yes; Therefore this variance is granted.
