ZONING BOARD OF APPEALS
April 14, 2004
The Town of Macedon Zoning Board of Appeals meeting was held on Wednesday, April 14, 2004, at the Town Complex, 32 Main Street, Macedon, NY. Present were Chairman Warren Jeffries, members Carl Eligh, John Gravino, Charles Packard and Ron Santovito. Also present was Councilman David Maul. Absent was Town Engineer Scott Allen.
Mr. Jeffries called the meeting to order at 7:30 p.m. There were no Public Hearings scheduled for this meeting.
OLD BUSINESS:
Z-02-04 – Wayside Garden Center/124 Pittsford-Palmyra Road (Route 31)/Area Variance – Section 135-162-B – Expansion of a non-conforming building – The public hearing for this variance was held on March 10, 2004. At that time the applicant was not present due to an oversight. There was no one else to speak for or against the granting of the variance at that time. Motion made by Carl Eligh, seconded by Charles Packard, to re-open this application. All in favor; motion carried.
Len Sorbello, owner of Wayside Garden Center, was present to explain his request. He would like to expand his building to the west, compensating for lost parking by moving the parking lot westward onto their adjoining parcel of land. That parcel is in Monroe County, and he will present a request to the Town of Perinton if Macedon approves the building addition.
Mr. Sorbello stated his garden center has done well at its present location, and he wishes to expand the business without changing its scope. The addition will be quonset style with glass at one end and probably not open in the winter. Total building area with the addition will be 19,000-20,000 sq. ft. Entrance/exit onto Route 31 will not be changed. Driveway around the addition will be 40-50 ft. wide.
Motion made by John Gravino, seconded by Charles Packard, to grant this variance under Section 135-162-B for a 60 ft. x 72 ft. building addition per plan submitted. Five factors were then reviewed.
Roll Vote: Eligh – yes; Gravino – yes; Packard – yes; Santovito – yes; Jeffries – yes; Therefore, this variance is granted.
