APPEALS BOARD MINUTES
 January 9, 2002

THE TOWN OF MACEDON ZONING BOARD OF APPEALS MEETING WAS HELD ON WEDNESDAY, JANUARY 9, 2002 AT THE TOWN COMPLEX, 1675 N WAYNEPORT RD, MACEDON, NEW YORK.  PRESENT WERE, CHAIRMAN WARREN JEFFRIES, MEMBERS, HELEN SAVERSKY, SUE BUSH, JOHN GRAVINO AND CHARLIE PACKARD.  ALSO PRESENT WAS CEO, SCOTT ALLEN.  ABSENT WAS TOWN COUNCILMAN, DAVID MAUL.

Mr. Jeffries called the meeting to order at 7:30 p.m.  Mr. Jeffries explained the purpose for which this board serves and read the legal notice as it appeared in the “Times”.

PUBLIC HEARING:

Gananda Ministry Center - Art Parts Signs / 3259 Canandaigua Rd / Area Variance - Section 135-190-B and 135-190-G / Request to add a second ground sign that is approximately 20 square foot in size
Patty Claffey of Art Parts Signs 100 Lincoln Parkway E. Rochester, NY 14445 was present to address the board.  She stated that the church was recently renovated and at the time it was discussed with Mario Fioravanti, previous CEO, that the sign were to be replaced.  She stated that one sign is already replaced and this sign is produced, ready to be installed.  When she came in to get the permit to replace the second sign she was told a variance was needed because the existing sign that this sign will replace was already removed.  She explained that the sign is to be approximately the same square foot as the old sign and would be in the same place, just turned at a perpendicular rather than an angle.  The old sign was ground lit; the new sign is internally lit with changeable copy.  The wording on the sign is to be different.  The board questioned if timers could be put on the internal lights.  Patty explained that this could be done, after some consideration the board made this a recommendation but the approval is not contingent on this issue.  No one else was present to speak for or against the granting of this variance.

James and Elaine Hartnagle / Route 31 / Area Variance - Section 135-85 schedule 1 / Request to build a mini storage building with a 73' front setback
James and Elaine Hartnagle of 445 Stafford Street Palmyra, NY 14522 and Joe Pullen P.E. of 2462 Magog Rd Palmyra, NY 14522 were present to address the board.  Elaine stated that the current front setback requirement for Route 31 is 250' and they were looking for a variance to have only a 73' setback.  She stated that the property is not wide enough for 250' setback due to the creek that runs along the back of the property.  She also explained that the board had already granted a 100' setback variance on this parcel, however, that application has been rescinded.  She explained that in order to get water to the property they would either need to go under the creek or across the restaurant property next door.  Because of this they have changed the proposal to a mini-storage building.  Elaine stated that it would have a gravel drive and be gravel all around the building.  By having a 73' front setback it allows them to meet the 50' setback from the creek.  Warren questioned the probability of people trying to pull out of this lot onto Route 31 in an area other than the designated driveway.  Elaine stated that the entire gravel area would be fenced and the only in/out would be the designated driveway.  She also explained that this would be gated for security reasons.  Elaine explained that the building would be 30'x100' and would hold approximately 27 units.  The fill that has been brought to the sight was questioned.  Elaine stated that the fill is to be leveled out.  It was determined that the Yellow Mills Diner, located next to this proposed building is approximately 40' from the road.  Elaine stated that they would like to start construction in the spring, however, planning board approval is still needed.  The proposed building is metal construction, similar to the storage units behind Jay's auto shop.  The signage for this project was questioned.  Elaine stated that she has not reviewed the code yet for this issue but would do whatever the code allows.  It was questioned why the proposed building is located at the narrowest part of the lot.  Elaine explained that this area was the highest part of the lot and is less likely to flood.  She also stated that this area was already cleared and would need the least amount of work.  Dave Privatera of 1324 Mary Drive Macedon, NY 14502 was present.  He stated that he was interested in learning the scope of this project because he owns other mini storage units within the town.  He also wanted to let the Hartnagles know that he has plans and approvals to expand his units this year.  No one else was present to speak against this application.

BOARD DISCUSSION

A motion was made by Sue Bush, seconded by Charles Packard to approve this application for a variance under Sections 135-190-B and 135-190-G for 3259 Canandaigua Road Macedon, NY 14502.  The timer on the sign lighting was discussed again and it was recommended to the applicant that this feature be added.  Five factors concerning an area variance were reviewed.
Roll Vote: Gravino-yes  Saversky-yes  Packard-yes  Bush-yes  Jeffries-yes Therefor this variance is granted.
 

James and Elaine Hartnagle / Route 31 / Area Variance - Section 135-85 schedule 1 / Request to build a mini storage building with a 73' front setback
A motion was made by John Gravino, seconded by Charles Packard to approve this application for a variance request with a 12 month abandonment clause under Section 135-85 schedule 1 for the property owned by James and Elaine Hartnagle on Route 31.  Five factors concerning an area variance were reviewed.
Roll Vote:  Gravino-yes  Saversky-yes  Packard-yes  Bush-yes  Jeffries-yes  Therefor this variance is granted.
Sue Bush stated that this variance is not to be used to set precedence for Route 31 setbacks.  This particular parcel has extenuating circumstances due to the creek and the topography that were taken into account when granting approval for this variance.

OTHER BUSINESS

Warren asked Helen if she was still work on a checklist for Variance Application standards.  Helen stated that she is still working on this issue.

Scott Allen stated that an application would probably be presented for Brownstone Physical Therapy who has recently moved into the West Wayne Plaza behind Pal-Mac Medical.  All signage for West Wayne Plaza has received a variance already in 1998, minutes were presented, however, Brownstone does not have any frontage to determine the sign of the size allowed.

Helen made the suggestion that name badges or business cards be supplied to the ZBA members to identify them as town employees when the are on site visits.  This may also be advantageous for others as well.

MINUTES  A motion to approve the minutes dated December 12, 2001 was made by Sue Bush, seconded by Charles Packard, all in favor.
