THE TOWN OF MACEDON ZONING BOARD OF APPEALS MEETING WAS HELD ON WEDNESDAY, OCTOBER 10, 2001 AT THE TOWN OF MACEDON COMPLEX, 1675 N WAYNEPORT ROAD, MACEDON, NEW YORK. PRESENT WERE, CHAIRMAN WARREN JEFFRIES, MEMBERS, HELEN SAVERSKY, CHARLES PACKARD, SUE BUSH AND JOHN GRAVINO. ALSO PRESENT WAS BUILDING AND ZONING OFFICER, MARIO FIORAVANTI. ABSENT WAS TOWN COUNCILMAN, DAVID MAUL.
Mr. Jeffries called the meeting to order at 7:30 p.m. Mr. Jeffries explained the purpose for which this board serves and read the legal notice as it appeared in the “Times”.
PUBLIC HEARINGS:
Littlefield / 2364 Canandaigua Rd / Area Variance - Section 135-61-A
/ Garage larger than allowed by town code
Tom Littlefield was present to address the board. He stated that
he bought this old farm house and was in the process of fixing it up.
He stated that he wanted to add a one story room on with a gabled front
garage measuring 24'x60'. He stated the garage would have three 16'
wide overhead doors. He presented architectural drawings and a survey
map of the property showing the addition on the south side of the residence.
Tom stated that he has recently planted 62 evergreen trees approximately
15-20' in height so the garage will be hardly noticeable from the road.
Tom explained to the board that the garage would be able to hold 6 vehicles,
however, it would be used as a shop for farm equipment repair and storage.
He stated that according to the code he could build a much larger pole
barn instead but preferred the larger garage so due to the look and for
heating purposes. He stated that the garage would not be used for
any commercial purposes, only to repair personal tractors, trucks and other
farm equipment. He presented a letter signed by all of his immediate
neighbors stating their lack of disapproval of the building of this garage.
Tom explained that when the house is finished with the additional room
it would be approximately 2400 square foot and would still be larger than
the garage. Tom stated that he also plans on adding on a porch to
the front, however, that does not effect anything here. Helen asked
how many vehicles would be stored in the garage. Tom stated two tractors,
various implements, cattle equipment and a dump truck would be stored.
He stated that currently this is stored outside and it would be much more
appealing to have it out if sight. Sue questioned how many barns
were currently on the property. Tom told that board that currently
there is 1 large barn (approximately 30x60') with a milkhouse attached
and a grainery. Tom explained that the upstairs of the large barn
is not suitable for the storage of farm equipment due to lack of structural
integrity and the downstairs of the barn is where the livestock is housed.
Tom explained that he currently did not have an attached garage and he
has done quit a bit of work on the house and barns already. Tom explained
that the house sits approximately 175' from the road. The new garage
and the house would be sided and matching. The board asked if Tom
had considered building anything smaller. Tom stated that if he built
a smaller garage he would still need to build a second pole barn.
The property is 10 acres. No one else was present to speak for or
against the granting of this variance.

Secore / 2141 Daansen Rd / Area Variance - Sections 135-61-B, 135-61-B-4
and 135-61-B-5 / Pole barn without a residence, higher than 16' and to
be built in front of proposed residence location
Matt Secore was present to address the board stating that he would
like to build a 60x99' barn on his property of 28 acres. He stated
that this property was located adjacent to his current residential property,
however, they are two separate properties. Matt explained that he
did not merge these properties because eventually he would like to build
a residence on the 28 acre parcel behind the proposed barn. Matt
explained that the barn would be approximately 1000' off the road and would
be built by Finger Lakes Construction. No maps of the total property
or location of the barn were presented. The board explained that
they would not be able to make a decision without a map showing the properties
in question and the location of the proposed barn. Mario Fioravanti
stated that the applicant was told a map would be needed and the applicant
responded that he had not understood that from their conversation.
Helen stated that in order to make a judgement a map would be needed.
Warren read the section of the Wayne County Planning Board letter stating
the importance of site information in making decisions on variances such
as this. Warren also explained that if the information was received
the board could still approve the application with a super majority despite
the recommended denial of the Wayne County Planning Board. Warren
also recommended that this application be tabled until further information
could be provided by the applicant. Matt stated that he did not want
to spend the money on a professional map if the board was not going to
approve this application. Helen replied that the board can not say
if the board would deny or accept this variance without a map. Sue
questioned why the applicant did not combine the 28 acre parcel with the
residential parcel located adjacent to avoid two of the variances.
After review of this option Matt decided that he would look into combining
the parcels and presenting further information to the board. It was
determined that this public hearing would be held open until the next meeting
and the applicant would be providing further information. No one
else was present to speak for or against this application.
-Planning Board recommended denial of this application due to
outstanding violations on the property, Mario explained that the applicant
is requesting to build this barn to relieve the burden of these violations
and he is waiting to see what decision is made here before taking the applicant
to court.

BOARD DISCUSSION

A motion was made by Helen Saversky to grant this variance under Section
135-61-A for Tom Littlefield at 2364 Canandaigua Rd Macedon, NY 14502,
seconded by Charles Packard. A motion to amend the previous to add
an 18 month abandonment clause was made by Sue Bush, seconded by Helen
Saversky, all in favor.
Five factors concerning an area variance were reviewed.
Roll Vote: Packard-yes Gravino-yes Bush-yes Saversky-yes
Jeffries-yes Therefor this variance is granted.
Hartnagle / Route 31
This application was tabled from the previous meeting. Mario
reported that nothing has been received from this applicant and it was
noted that the town board denied the refund of her application fee.
Due to the closing of the public hearing the applicant has until the next
meeting to submit information for review; Jennifer Habecker will mail a
letter to Mrs. Hartnagle informing her of this deadline. A motion
to re-table this application was made by Helen Saversky, seconded by John
Gravino, all in favor.
MINUTES A motion to approve the minutes from September 12, 2001 was made by John Gravino and seconded by Helen Saversky, all in favor.
OTHER BUSINESS
Warren shared information on a training class.
Sue asked if maps could be received prior to meetings. Jennifer
Habecker explained that the applicants don't always provide maps and at
times only one map is provided. Whenever possible maps are mailed
with the application.
