APPEALS BOARD MINUTES
 March 13, 2001

THE TOWN OF MACEDON ZONING BOARD OF APPEALS MEETING WAS HELD ON TUESDAY, MARCH 13, 2001 AT THE TOWN COMPLEX, 30 MAIN STREET, MACEDON, NEW YORK.  PRESENT WERE, CHAIRMAN WARREN JEFFRIES, MEMBERS, HELEN SAVERSKY, SUE BUSH AND JOHN GRAVINO.  ALSO PRESENT WAS TOWN COUNCILMAN DAVID MAUL.  ABSENT WAS BUILDING AND ZONING OFFICER, MARIO FIORAVANTI AND ZBA MEMBER CHARLES PACKARD.

Mr. Jeffries called the meeting to order at 7:33 p.m.  Mr. Jeffries explained the purpose for which this board serves and read the legal notice as it appeared in the “Times”.

PUBLIC HEARING:

Kevin Reader / 570 Quaker Rd Lot 32 / Area Variance - Section 135-164-h-1 / Would like to build a storage shed larger than allowed by town code
Kevin Reader was present to address the board concerning this application.  He stated that he currently has an 8'x8' shed and would like to replace it with a 12'x12' shed.  The new shed would be in a different location because the existing shed  location does not meet town code.  Kevin stated that the shed would store his lawn maintenance equipment including a lawn mower, chain saws, weed wackers, tools, camping equipment, etc.  Warren asked if there were other storage sheds in this mobile home park of the same size.  Kevin responded that there were several.  Kevin had a letter signed by "management" stating that permission was granted for this new shed.  Helen asked if the shed would be on the North side.  Kevin replied that it would be on the East Side, which is where the current shed is located, but further back to meet town code.  Kevin prepared a drawing and presented to the board.  Sue asked about the timeframe in which he was planning to build the shed.  Kevin replied that he had vacation in April and was planning to take the old one down and put the new one up during that time.  No one else was present to speak for or against the granting of this variance.

BOARD DISCUSSION

Kevin Reader / 570 Quaker Rd Lot 32 / Area Variance - Section 135-164-h-1 / Would like to build storage shed larger than allowed by town code
A motion was made by Sue Bush to grant this variance under Section 135-164-h-1 for 570 Quaker Rd Lot 32 with an 18-month abandonment clause, seconded by Helen Saversky.  Helen began conversation on this application by stating that she had no concerns as the shed is done in good taste and is not higher than the home.  John Gravino asked about the timeline and Warren Jeffries explained the abandonment clause.  Warren asked if the shed was going to be large enough.  Kevin responded that he would probably outgrow the shed in five years but was not planning on living there that long.  Five factors concerning an area variance were reviewed.
Roll Vote: Saversky-yes  Gravino-yes  Bush-yes  Jeffries-yes Therefor this variance is granted.

OTHER BUSINESS

Sue Bush had a couple of questions for Mario Fioravanti concerning two sites.  The fist was concerning the size of the pole barn on Victor Rd.  The second was the pole barn being built on Farmington Rd before a residence is built.  Mario Fioravanti was not present, Jennifer Habecker will take these questions to him for response.

Helen Saversky questioned the decision not to appoint an alternate to the board.  Dave Maul responded that he has not received any further information from the Town Attorney on this matter but he thought the attorney might have made the recommendation against an alternate due to the unpaid status of the position.  Helen asked why no one on the town board questioned the attorney's recommendation.  She stated that being a new attorney for the town it might be in the town's best interest to question why he made this recommendation.  Dave Maul responded that he would look into this matter further and get back to her.  Helen added that she felt an alternate was a fabulous idea and Joe would have been an asset to the board.  She also stated that it was a recommended practice to have alternates for the boards.  Dave stated that he thought again that the attorney made the recommendation due to the unpaid status and due to the position not being in the budget the town board could not approve the position as paid.  Dave also told Helen that he would address this issue at the town board level at the next meeting.

MINUTES  Minutes from February 13, 2000 were present for reviewed.  Approved with amendments.
