A Regular Meeting of the Town Board of the Town of Macedon held September 22, 2011 at the Town Complex, 32 Main Street in the Village of Macedon, was called to order by Supervisor William Hammond at 7:30 P.M.

RESOLUTION NO. 177 (2011) APPROVAL OF MINUTES

RESOLVED the Board approves the minutes of September 8, 2011 with the following corrections:

          1.  Resolution No. 174 (2011)

          Abstract 9 (2011) Claim Nos. 24698-24856

          Expenditures in the amount of $324,748.77

2.     Spelling Correction: Kathleen D’Ambra inquired about a sign DOT

agreed to replace at the intersection of Route 31F and Canandaigua

Road. Highway Superintendent Roets will look into.

CORRESPONDENCE – The Supervisor presented the following:

The American Red Cross held a blood drive on August 25, 2011 in the Community Room.  The donations helped 105 patients.

 

RESOLUTION NO. 178 (2011) IMMUNIZATION CLINIC – CVS OFFSITE AT TOWN HALL

RESOLVED the Town Board authorizes the Supervisor to sign the Influenza Vaccination Agreement (On-Site; Patient Pay) between the Town of Macedon and CVS scheduled on October 3, 2011 at 11:00 a.m. to be held in the Town Hall, 32 Main Street, Macedon, NY.

RESOLUTION NO. 180 (2011) POLICE EQUIPMENT AUTHORIZED

RESOLVED the Supervisor be authorized to sign contract to lease for 48 months a Toshiba e-Studio 355SE Digital Copier/Printer/Scanner/Fax for a cost of $96/month plus $.00575/image, Wayne County Bid Pricing, to be expensed from A3120.400.

7:35 PM – PROPOSED LOCAL LAW NO. 2 PUBLIC HEARING

 

Local Law No. 2 of 2011 grants additional authority to regulate traffic in parking lots relating to traffic control devices.

 

RESOLUTION NO. 181 (2011) WAIVE READING OF THE LEGAL NOTICE

WHEREAS the legal notice was published in the September 11, 2011 issue of the Times

 

RESOLVED the Town Board waives reading of the legal notice.

With the growth in commercial property, this proposed local law will allow the Police Department authority to regulate traffic, such as fire lane violations, stop signs and DWI’s in parking lots when necessary.

RESOLVED the Public Hearing be closed at 7:38 p.m.

RESOLUTION NO. 183 (2011) LOCAL LAW NO. 2 (2011) GRANTING ADDITIONAL AUTHORITY TO REGULATE TRAFFIC IN PARKING LOTS

BE IT ENACTED BY THE TOWN BOARD OF THE TOWN OF MACEDON AS FOLLOWS:

Pursuant to ‘1100 of the Vehicle and Traffic Law of the State of New York, the provisions of Title VII (Rules of the Road) relating to obedience to stop signs, flashing signals, yield devices, and to one-way, stopping, standing, parking and turning regulations shall apply to parking lots within the Town of Macedon.

 

This local law shall be effective upon its filing with the Secretary of State.

Supervisor Hammond, Councilman McEwen and Councilman Kenyon will be attending a meeting to be held by the State Comptroller’s Office regarding the tax cap.

 

It is the sole responsibility of the town board to approve a budget that is in compliance with the levy limit law or to enact an override.  The Town Board will hold a budget workshop on October 6, 2011 at 5 p.m.  With all the variables involved with the tax cap and time restraints, a public hearing will be held on October 13, 2011 on a proposed local law to override the tax levy limit.  This will allow sufficient time to adopt the local law if the Town Board deems it necessary.  The state has said the public hearing may be held on the same date as the hearing on the preliminary budget, however, the local law must be filed with the Secretary of State.  In order to comply, as the Town does with all other local laws, a public hearing would normally be held on October 13, 2011 allowing time to adopt and file with the Secretary of State. The local law would become effective with the date of filing.  At the present time the State has said they would waive this filing time.  If the Town Board passes the override local law, they do not have to exceed the levy limit.  Preliminary budget public hearings will be held October 27, 2011.  All meetings are open to the public and the Town Board encourages residents to attend throughout the process.

 

RESOLUTION NO. 185 (2011) PROPOSED LOCAL LAW NO. 3 (2011) PUBLIC HEARING SET

RESOLVED the Town Board schedule a public hearing on October 13, 2011 at 7:45 p.m. to hear public comment on proposed Local Law No. 3 (2011) entitled a local law to override the tax levy limit established in General Municipal Law 3-c.

Chief Colella reported the Uniform Crime/Incident-Based Reporting Index Crime Summary for Counties by Agency for Macedon from January through June 2010 versus 2011 has decreased by 65%.  Larceny had decreased by 54% and property by 55%.

 

Town Accountant, Kim Leonard and Supervisor have completed an audit of the Court.  It will be presented along with the Court records at the next regular town board meeting for review.

 

RESOLUTION NO. 186 (2011) EXECUTIVE SESSION

RESOLVED the Town Board enter Executive Session at 8:10 p.m. to discuss a particular personnel matter.
