A Regular Meeting of the Town Board of the Town of Macedon held August 12, 2010 at the Town Offices, 32 Main Street in the Village of Macedon, was called to order by Supervisor William Hammond at 7:30 P.M.

RESOLUTION NO. 176 (10) MACEDON CENTER FIRE ASSOCIATION FIRE PROTECTION SERVICES PUBLIC HEARING SET

RESOLVED that a public hearing be set for October 28, 2010 at 7:40 p.m. prevailing time at the Macedon Town Hall for the purpose of obtaining public comment on the proposed fire protection agreement between the Town of Macedon and the Macedon Center Volunteer Firemen’s Association for fire protection services for the year 2011.

RESOLUTION NO. 180 (10) SURPLUS BID AWARD – 2003 FORD CROWN VICTORIA

BE IT RESOLVED the Town Board rescinds award of the 2003 Ford Crown Victoria in RESOLUTION NO. 165 (10) SURPLUS EQUIPMENT BID AWARD due to the highest bidder failing to comply and

 

BE IT RESOLVED the Town Board awards the vehicle to the second highest bidder, Alpco Recycling in the amount of $276.

BE IT RESOLVED that the Chief of Police is authorized to purchase a new Patrol Room desktop computer to replace an existing computer, which is no longer functional, not to exceed $800 to be expensed from AF3120.200 at no cost to the taxpayers.

Chief Colella received a NYS Grant in the amount of $1,147 for Buckle Up NY.

 

Route 31 speed limit has been reduced to 50 mph by DOT from the County Line to Wilson Road. 

 

Supervisor Hammond thanked Kevin Rooney, Wayne County Highway Superintendent, for his efforts in straightening the intersection at County Road 28 and Route 31.  Kevin is working on the acquisition of the property, which the County just approved.

 

The Town of Barker has asked for support of horizontal drilling in the Marcellus Shale formation.  The Board would like more information from Scott Allen, Town Engineer.

 

The Village of Macedon will unveil their mural this Saturday at 4 p.m.  The Lumberjack Festival will be held September 11 and 12, 2010.  Macedon Police Association and Ambulance Volunteers will be holding a golf tournament on September 25th.

RESOLUTION NO. 185 (10) WALWORTH/MACEDON SETTLEMENT

RESOLVED the Town Board approves the modification to the Walworth/Macedon settlement as set forth in draft dated 7/13/2010 annexed.

A lengthy discussion followed on new cost figures for Wayne County Workers Compensation Plan. Town Attorney Anthony Villani and Supervisor Hammond met with

Keith Kubasik to review the formula used.  They use an anticipated budget, benefits, reserve and overhead. Participants pay 25% of payroll cost, 25% of respective assessment of real property in the town.  The charges to Macedon were as follows:

2009    $135,970

2010    $266,130

2011    $418,987

Charges are based on a three (3) year loss experience with number of claims generating the rate. The Town of Macedon had two (2) employees hurt with large claims.  One employee was hurt while working on a county road.  Coverage by the County under the hold harmless is being pursued.  The Board feels the County should pick up this employee retroactive.  Buy out cost from this plan would be $55,130.  At the meeting the Attorney and Supervisor were told the premium would not be required if they opted to pay the buy out from the plan for $55,130.   Other options for workers compensation are being evaluated.

 

Attorney Villani cautioned the Board to be aware of WCIDA’s new procedure of offering a pilot program to a business already built versus a new project.  It was questioned why the business should get a tax break for something already in the ground.

 

It was the consensus of the Town Board not to loan out tables and chairs due to liability.

On January 1, 2011 the New York State Department of Agriculture and Markets will no longer provide license renewals or maintain dog licensing data as a service to municipalities.  Municipalities currently authorized to license dog licenses will assume the licensing function.
