A Regular Meeting of the Town Board of the Town of Macedon held August 24, 2006 at the Town Offices, 32 Main Street in the Village of Macedon, was called to order by Supervisor William Hammond at 7:30 P.M.

The Town Board is looking at alternative medical coverage for the Town employees. Relph Benefit Advisors acts as a broker.
RESOLVED the Supervisor be authorized to sign broker of record letter for Relph Benefit Advisors.

RESOLVED the Board waives reading of the legal notice published in the August 14, 2006 issue of the Times

This local law would abolish the elected position of Receiver of Taxes & Assessments and establish the position as an appointed one. The current Receiver of Taxes & Assessments will be retiring at the end of his term and the intention is to place the responsibility in the Town Clerk’s Office. This will provide residents with longer office hours.
No residents desiring to be heard, the public hearing was closed.
RESOLVED the Public Hearing be closed at 7:50 p.m.

LOCAL LAW NO. 6 – ABOLISHING THE ELECTIVE OFFICE OF RECEIVER OF TAXES & ASSESSMENTS & THE CREATION OF THE APPOINTIVE OFFICE OF THE RECEIVER OF TAXES & ASSESSMENTS
RESOLVED the Town Board adopts Local Law No. 6 Abolishing the elective office of Receiver of Taxes & Assessments and the creation of the appointive Office of the Receiver of Taxes & Assessments subject to a mandatory referendum and authorizes the Clerk to submit it to the Board of Elections to be on the ballot in the November elections.

RESOLVED that a public hearing be set for October 26, 2006 at 7:35 p.m. prevailing time at the Macedon Town Hall for the purpose of obtaining public comment on the proposed fire protection agreement between the Town of Macedon and the Macedon Center Volunteer Firemen's Association for fire protections services for the year 2007.

RESOLUTION NO. 172
(06) PRELIMINARY BUDGET PUBLIC HEARING SET
RESOLVED the public hearing be set for October 26, 2006 at 8:20 PM prevailing time at the Macedon Town Hall for the purpose of obtaining public comment on the preliminary 2007 budget for the Town of Macedon and directs the Clerk to publish notice of said hearing.

IT IS HEREBY RESOLVED by the Town of Macedon, State of New York that:
WHEREAS, In Homeland Security Presidential Directive (HSPD)-5, the President directed the Secretary of the Department of Homeland Security to develop and administer a National Incident Management System (NIMS), which would provide a consistent nationwide approach for federal, state, local and tribal governments to work together more effectively and efficiently to prevent, prepare for, respond to, and recover from domestic incidents, regardless of cause, size or complexity; and
WHEREAS, the collective input and guidance from all federal, state, local and tribal homeland security partners has been, and will continue to be, vital to the development, effective implementation and utilization of a comprehensive NIMS; and
WHEREAS, it is necessary that all federal, state, local and tribal emergency management agencies and personnel coordinate their efforts to effectively and efficiently provide the highest levels of incident management; and
WHEREAS, to facilitate the most efficient and effective incident management it is critical that federal, state, local, and tribal organizations utilize standardized terminology, standardized organizational structures, uniform personnel qualification standards, uniform standards for planning, training and exercising, comprehensive resource management and designated incident facilities during emergencies or disasters; and
WHEREAS, the NIMS standardized procedures for managing personnel, communications, facilities and resources will improve the state’s ability to utilize federal funding to enhance local and state agency readiness, maintain first responder safety, and streamline incident management processes; and
WHEREAS, the incident Command System components of NIMS are already an integral part of various incident management activities throughout the state, including all public safety and emergency response organizations training programs; and
WHEREAS, the National Commission of Terrorist Attacks (9-11 Commission) recommended adoption of a standardized Incident Command System
NOW, THEREFORE, Pursuant to the authority vested in me by the local authority and provisions of local law. I do hereby mandate the National Incident Management System be utilized for all incident management in the Town of Macedon.
I further proclaim this to take effect immediately.

RESOLUTION NO. 174 (06) NYS INCOME TAX PAYMENT PENALTY CHARGE DUE TO MAIL DELIVERY ISSUES
RESOLVED the Macedon Town Board authorize the interest payment to the
Commissioner of Taxation & Finance – NYS Assessment Receivables for the late filing of NYS Income Tax payment for check #23676 dated 1/15/2006 lost in the mail in the amount of $33.21 charged to A1320.400, penalties of $228.40 waived and be it further recognized
Payments are now being done through the internet e-filing to avoid any future mail delivery issues. Paperwork and appeals attached to Voucher #13614.

The Town Clerk certified there were no petitions filed against the Pal-Mac School egress offer.
The Town Board is not interested in contracting with Lu Engineering for road
signage.
Route 31 speed reduction request from Monroe County Line to Wilson Road was denied. The Town Board will pursue at a later date.
Rob Williams looked at the drainage situation in the Hance Road area. He felt the Town has done all they could do. Scott Allen requested Parrone check the water retention pond. He has not received a response.
Highway Superintendent Roets informed the Board Wilkinson Road and Ryder Lane have been paved.
The Town Board acknowledged the new Bullis Park sign and thanked the Police Union. There will be a dedication ceremony Saturday at 9 a.m.
RESOLVED the Board enter Executive Session at 8:30 p.m. to discuss litigation.
