A Regular Meeting of the Town Board of the Town of Macedon
held April 27, 2006 at the Town Offices, 32 Main Street in the Village of
Macedon, was called to order by Supervisor William Hammond at 7:30 P.M.

RESOLUTION NO. 111 (06) FARMLAND PROTECTION CONSERVATION EASEMENT
WEBER, KEMP, GELDORF & TOOMEY
RESOLVED that Supervisor Hammond is authorized to submit an
application for funds, not to exceed $614,631, from the USDA National Resource
Conservation Service 2006 Farm and Ranchland Protection Program for the farms
that are awarded funding in the NYS Department of Agriculture and Markets
farmland protection program and, be it further
RESOLVED that Supervisor Hammond is authorized to sign on behalf of the Town of Macedon an option to purchase an agricultural conservation easement with the following farmers as part of the USDA NRCS farmland protection program, pending approval by the Town Attorney for form and content; Weber, Kemp, Geldorf & Toomey.

RESOLVED that the Town Board for the 2006 USDA NRCS Farm and Ranchland Protection Program grant proposal, does hereby wish to prioritize the farms in the proposal first, by the award year of the New York State Department of Agriculture and Markets (NYSDAM) project and second by the number of acres of land on each farm that are in the NYSDAM Soil groups 1, 2, 3, 4 or 5. Therefore for the above referenced project, the project farms would be ranked 1) Weber; 2) Kemp; 3) Geldorf; 4) Toomey.

RESOLVED the copy of the Budget prepared by the Wayne County Planning Department dated 4/27/2006 be submitted on behalf of the Geldorf, Kemp, Weber and Toomey Farms and for the Town of Macedon 2006 USDA FRPP Grant Application.

RESOLVE to authorize prepayment to NYS Unemployment Insurance to cover expenses incurred for 1st Qtr-2006 in the amount of $2,519.00 expensed to MS1930.400 and allow Town Accountant to do necessary budget adjustments.

Councilman Nawrocki announced the Town received a formal application from Lowes. This will bring 175 employees, 75% full-time with benefits and a $6 million dollar payroll. Lowes received approval before the County Planning Board last night.

REQUEST

Jim Beckenbach requested the Board consider a modification of his special use for Salvage & Recycling to allow removal of approximately eight (8) feet of his berm. This will expose the top half of his building from Route 31 for signage.
An individual questioned where the dirt was going. Mr. Beckenbach is donating the soil to the Erie Street project.
RESOLVED the Public Hearing be closed at 8:10 p.m.

The Planning Board gave it a positive referral.
BE IT RESOLVED that the Town Board approves the modifications to the SRSPC as per the application dated April 17, 2006 by JMB Properties, LLC to the Town.

A lengthy discussion followed on the Hillside Children’s Center application to locate a home for children with developmental disabilities in the Town of Macedon. Hillside purchased a home located on Farmington Road to establish a community residence or Individual Residential Alternative. This home would house five (5) individuals with special needs.
After purchasing the residence, Hillside made a formal application to the Town on December 7, 2005. The Town was given forty (40) days after the receipt of the letter to respond in one of three ways:
The Macedon Town Board held a public hearing on January 12, 2006 to hear and consider public comment. On January 13, 2006 the Board notified Hillside they disagreed with the proposed site and expressed its dismay that Hillside chose not to solicit any input or comment from our community leaders or residents prior to the purchase. Six (6) alternative sites were suggested.
In an undated letter from Hillside the six proposed sites were rejected. They
felt comparable sites at this point would have been existing homes.
March 10, 2006 the Town suggested an alternate site on Canandaigua Road along with a request for an immediate hearing before the NYS OMRDD Commissioner, Thomas A. Maul on the original application and alternate sites.

The Town Board stated there was no pending application for the Canandaigua Road location. Hillside would have to withdraw the original application for Farmington Road and reapply for Canandaigua Road. The Town should be given the same process for the Canandaigua Road property as Farmington Road.
RESOLVED the Board enter Executive Session at 8:24 p.m. to discuss litigation.

Several residents asked questions and voiced their concerns.
Councilperson Maul stated the Town has a legal and moral obligation to look at this application. These individuals are born with disabilities beyond any control of theirs. The question is trying to find the right site.
Greater Macedon Days is back and will be held July 15 and 16. If anyone is interested in helping please contact Sandy Pagano.
