Tonight the Town Board will
hold public hearings on the fire and ambulance contracts. The actual public hearing on the preliminary
budget will be held on November 10, 2005 due to an incorrect salary in the
legal notice. The notice will be
published again in the October 31, 2005 issue of the Times.

Jim
Smith requested a reciprocal easement approximately 75 foot square across town
property on Rt. 31F near the water tower.
Mr. Smith would like to have the ability to transfer the easement to the
next owner should he sell. This easement would provide better access to the
rear of his property where he would like to extend the current driveway and
construct a building. The attorney will
research the Town’s ability to do this.

authorizes $70,800 for fire protection and $60,357 for ambulance service for a

the sum of $60,357 for ambulance to the Village of Macedon, which includes
coverage town wide by ambulance and fire protection for the Macedon Fire
Protection District for a total of $131,157 for the calendar year 2006.

Michael
Venturo, Popli Consulting Engineers & Surveyors requested a waiver of the
Land Use Regulations 75-28 as it applies to the proposed Forsay 3 Lot
Subdivision West. The parcel is
approximately 21 acres with 802 feet of frontage on West Walworth Road. The Board requested that Lots 1 and 2 be
split evenly with equal frontage. When
this is complete the Board will address again.
Supervisor
Hammond read a letter from Deborah and Keith Gierman dated October 25, 2005
listing their concerns.

CONSERVATION EASEMENT BUDGETS
RESOLVED
that the Town Board hereby approves the proposed project budgets for the
agricultural conservation easements for Richard Jozwiak and Carol Jozwiak and
for Harlan Hilton III, Harlan Hilton Jr. and Robin Hilton, copies of which are
annexed hereto, and it is further

that the Town accountant is authorized and instructed, upon receipt of the
project funds from the State and Federal governments, to wire the funds to the
Town Attorney Trust Account for disbursal, in accordance with the budgets.

Councilperson
David Maul gave a detailed presentation on the proposed 2006 budget. The 2006 tax rate for residents outside the
Village, not including special districts, will be $4.28/$1,000 assessment, which
has not changed from last year.
Residents inside the Village will pay $3.62/$1,000 assessment. This is up $.58 due to the Police Department
becoming a Town charge. The Village
residents should have seen a decrease in their Village taxes reflecting this
change. The actual public hearing will
be held on November 10, 2005.

Frank
Maciuska, Walworth Councilperson and Paul Russell, Engineer for the Town of
Walworth requested the Town Board pass two (2) resolutions supporting the trunk
sewer expansion for the Walworth/Gananda Sewer District. Phase I would bring the sewer from the south
side of the wetlands to the north and Phase II would bring the sewer to the
industrial zone. These resolutions
would be contingent upon IDA funds. The
consensus of the Board was that the Town of Walworth needed a guarantee versus
speculation on industry before the IDA would commit. They will get more information and possibly return on November
10, 2005.
RESOLUTION
NO. 306 (05) PROPERTY PURCHASE -
WEISSCHADEL
WHEREAS,
the Town of Macedon, pursuant to authority under New York State Town Law
Section 220 is desirous of acquiring through purchase land located at 1797
Canandaigua Road, Macedon, New York; now, therefore,
BE
IT RESOLVED, that the Town Board of the Town of Macedon has reviewed and hereby
approves the proposed Purchase and Sale Contract for purchase of the aforesaid
land and property located at 1797 Canandaigua Road, Macedon, New York, which
property is more specifically described in said Purchase and Sale Contract and
hereby authorizes and directs the Supervisor of the Town of Macedon, on behalf
of the Board, to execute said Purchase and Sale contract on behalf of the Town
of Macedon, and to execute and deliver and, where appropriate, cause to be
filed or recorded of record, any and all documents on behalf of the Town of
Macedon as may be necessary or proper for the purpose of obtaining marketable
title to the aforesaid property for the Town of Macedon, subject to any SEQRA
review, permissive referendum, or other requirements applicable by law.
