A Regular Meeting of the Town Board of the Town of Macedon held August 25, 2004 at the Town Offices, 32 Main Street, in the Village of Macedon, was called to order by Supervisor William H. Hammond at 7:30 p.m.

The Supervisor reported that the Farmer's Market went over very well.

RESOLUTION NO. 190 (04) APPROVAL OF MINUTES

RESOLVED the Town Board approves the minutes of the August 12, 2004 Board Meeting.

RESOLUTION NO. 191 (04) BUDGET ADJUSTMENT

RESOLVED that the Town Board authorize the following budget adjustments:

DA 0510 Estimated Revenues $2,727.00

DA 2401 Interest 27.00

DA 2770 Tree Grant $ 2,700.00

DA 0960 Appropriations $2,727.00

DA 5142.401 Ice Storm Expenses 2,727.00

To record budget adjustment for increases to revenues and expenses for tree replacement from ice storm damages through County Grants.

RESOLTUION NO. 192 (04) BUILDING & ZONING CAR DECLARED SURPLUS

BE IT RESOLVED that the 1993 Caprice used for Building and Zoning Transportation be declared surplus and the Town Clerk is authorized to advertise for bids, and that a minimum bid of $750.00 be acceptable.

RESOLUTION NO. 193 (04) DRAINAGE EASEMENT SIGNATURE

RESOLVED that the Supervisor be authorized to sign drainage easement between Lawrence Packard, Eugene Brown, and Herbert Boyce, property known as Lot 5 on Quaker Road/ Wayneport Road.

RESOLUTION NO. 194 (04) EMPIRE NATURAL GAS CONTRACT

RESOLVED Supervisor be authorized to sign Nonresidential Firm Gas Sales & Purchase Agreement with Empire Natural Gas Corporation for the Library, Town Complex, and Highway Barn.

RESOLVED the Town Board set Saturday, October 2nd for the Budget Workshop from 7 a.m. to 12 noon.

RESOLVED the Town Board authorizes Scott Allen to send the Notice of Unsafe Property & Order to Remedy pending Town Attorney Anthony Villani's review.

RESOLUTION NO. 197 (04) 1306 MARY DRIVE - NOTICE OF UNSAFE

PROPERTY & ORDER TO REMEDY PUBLIC

HEARING

RESOLVED the Clerk be authorized to advertise public hearing in relation to Notice of Unsafe Property & Order To Remedy 1306 Mary Drive per the process outlined by the Code Enforcement Officer in letter dated August 25, 2004 to Washington Mutual Bank.

CORRESPONDENCE - The Supervisor presented the following:

  1. Wayne County Soil & Water District has scheduled a residential tire collection day to
  2. be held on Saturday October 2nd between 8 a.m. and 2 p.m. You must pre-register to

    receive a scheduled drop-off time and pay $1.00 per tire. This is a first come-first

    serve event with only 2,000 tires being collected. Call (315) 946-4136 for more

    information.

  3. A letter from Charles Bastian, Bernard P. Donegan, Inc. regarding grant dollars for the Landfill Closure Capital Project.
  4. Town Budget Calendar
  5. Discussion followed on contacting the Town of Walworth and Gananda School Board to determine if a joint meeting was necessary.

RESOLUTION NO. 198 (04) HIGHWAY SUPERINTENDENT SCHOOLING

RESOLVED the Town Board authorizes Dick Roets to attend the New York State Highway Conference to be held in the 1,000 Islands from 9/23-25/04 not to exceed $600 to be expensed from A5010.400.

The Chamber of Commerce will hold the Business Spotlight at the Garlock House tomorrow night if anyone is interested in attending.

The Gananda Crossing Guard will be able to cross children at Wiedrick Road this year.

Councilperson Maul installed an anti-virus program on the Court computers and they now have Internet access.

Councilperson McEwen met with the Library Board today. The Friends Group (including CRMPL and the Bullis Committee) have been awarded from the New York Library Association the Daniel L. Casey Library Advocacy Award. This yearly award will be presented at the NYLA Convention in October.

RESOLUTION NO. 199 (04) BULLIS ROOM WINDOW REPLACEMENT

BE IT RESOLVED to move to authorize expenditures not to exceed $2,500 to replace the window frames for two (2) windows in the Bullis Room with thermal break window frames to prevent the condensation problem in Bullis Room pending engineer specifications.

The Board felt that rather than chance a special election that would cost the taxpayers $3,500 the police housing issue should be a proposition on the November ballot. It was felt that more residents would vote in the presidential election than in a special election held shortly thereafter.

RESOLUTION NO. 200 (04) POLICE HOUSING PROPOSITION

Shall the Town of Macedon be authorized to expend seven thousand five hundred dollars ($7,500) to continue the lease of the property located at 96-98 Main Street, Macedon, New York to house a town-wide Police Department?

RESOLUTION NO. 201 (04) POLICE HOUSING REFERENDUM ON NOVEMBER

ELECTION

The aforesaid proposition shall be subject to the voters of the Town of Macedon at the next General Election to be held on November 2, 2004. All electors of the Town of Macedon qualified to vote at the aforesaid General Election by the Wayne County Board of Election shall be qualified to vote upon this proposition. The Town Clerk and the Town Attorney are hereby directed to take all appropriate steps to have proposition submitted at the next general election.
