A Regular Meeting of the Town Board of the Town of Macedon held January 22, 2004 at the Town Offices, 32 Main Street, in the Village of Macedon, was called to order by Supervisor William H. Hammond at 7:30 p.m.

Upon Roll Call, the following members of the Board were present:

Supervisor Hammond stated that the Public Hearing scheduled for the Laker Development rezoning request was cancelled due to an error in the legal notice. The public hearing will be rescheduled on February 12, 2004 at 8:00 p.m.

B. Yvonne Selbig, Community Coordinator-Generation for RG&E presented the Rochester transmission project to improve and expand its power delivery system in the Rochester area to provide reliable, secure and essential service. This project will enhance RG&E's ties to the state's high-voltage power grid. RG&E will close the Russell Station in 2007 due to tougher NYS air regulations. The project will begin in the spring of 2005 and will include Macedon. Additional information is available on their web site at rge.com and click on "Rochester Transmission Project".

Beth Grier-Leva requested the Town Board support the formation of a Macedon Community Center Committee. Supervisor Hammond thanked the Macedon Recreation Committee for the Macedon Town Messenger. He has had very favorable feedback. Macedon Recreation has a total of 48 gym hours available at the Palmyra-Macedon Schools of which 47-1/2 hours are currently booked. If a session is bumped there is no opportunity to reschedule. The Recreation Program can not be increased due to lack of space. A community survey will be distributed in the Town of Macedon Messenger within two months.

RESOLUTION NO. 44 (04) MACEDON COMMUNITY CENTER COMMITTEE

RESOLVED the Board appoints the following individuals to the Macedon Community Center Committee:

Norb Miller, Recreation Director

Beth Grier-Leva, President

Doug Camp, Jim DePuy, Ron Fogarty, Paul Hirliman, Jim Patchett, Doc Rising,

Mary Ann Russell and Dave Standinger

And be it further resolved that the committee will:

Assess community need for a community center

Assess community's desire/support for a community center

Conduct a feasibility study of possible site location

Research potential cost of community center and funding opportunities

And be it further resolved that the Community Center Committee will be an offspring of the Macedon Recreation Committee and Paul Kenyon will act as the liaison between the Town Board and the Community Center Committee

And be it further resolved that the committee will regularly report any and all findings to the Town Board with regards to the community center with recommendations as to possible next steps.

Cheryl LaTray presented a proposal for an indoor sports complex to be located on Route 31 east of the mobile home park. Phase 1, a private venture, would consist of two (2) indoor soccer fields, indoor sand volleyball courts, fitness center, physical therapy clinic, and café at a cost of $3.2 million. The Phase I building size will be 67,000 square feet, which will be completed in 2004. Phase 2, a not-for-profit venture, would consist of an indoor track at a cost of $4 million and be 105,000 square feet to be finished in 2005 with seating capacity for 2,400. The developer will be applying for a $2 million grant for phase 2 and is not looking for taxpayer funds. The facility will be available to school groups, leagues, developmentally disabled, seniors, home school children, for walking and physical therapy. The sports complex will create 17-19 jobs. Support from the Wayne County Board of Supervisors has been received, and the developer anticipates the Wayne County Planning Board will also support the proposal.

RESOLUTION NO. 45 (04) SPORTS CENTER PROPOSAL

RESOLVED the Town Board finds,per Town Code Section 135-89 C 6, that this proposed use is similar in nature and scale to the uses listed in that section and further supports the submission by the developer to apply for a special member grant in the name of the Town for a proposed sports center, as presented to the Town Board on January 22, 2004.

RESOLUTION NO. 49 (04) VILLAGE OF MACEDON - ELECTION MACHINE

USAGE

RESOLVED the Town Board authorizes the Village of Macedon to use two (2) Town of Macedon voting machines for their Village Election to be held March 16, 2004 at the Village Highway Barn and that any cost for damages will be borne by the Village of Macedon.

BE IT RESOLVED that the Palmyra-Macedon School District be authorized to hold school votes in the Town of Macedon Community Room located in the Macedon Public Library upon scheduling with the Town Clerk's Office and be it further

RESOLVED that the Palmyra-Macedon School District be authorized to use the Town of Macedon Voting Machines and be it further

RESOLVED that the Palmyra-Macedon School District will be responsible for all costs incurred.

RESOLVED that the Town Board appoints Allen Conroy and Shane Schumann to the position of Election Custodians as per the recommendation of the respective political parties effective January 22, 2004 at a rate of $60/machine/setup for Town elections and be it further

RESOLVED that Richard Baker and Lucille Hamlin be reappointed to the position of party representatives effective January 22, 2004 at a rate of $25 per election for Town elections.

RESOLUTION NO. 53 (04) HANCE ROAD DRAINAGE PROJECT AGREEMENT

RESOLVED the Town Board authorizes the Supervisor to sign the Wayne County Soil & Water Conservation District Agreement for drainage improvement services on Hance Road to be expensed from SD8510.400.

RESOLUTION NO. 54 (04) JUDGES TEMPORARY ASSIGNMENT

RESOLVED the Town Board consents to the temporary assignment of its justices to preside in other town/village courts in the Seventh Judicial District as need arises during the year 2004 and approves the temporary assignment of judges from other town/village courts in the Seventh Judicial District to its court as need arises during the year 2004.

RESOLUTION NO. 55 (04) LAKER DEVELOPMENT REZONING PUBLIC

HEARING RESCHEDULED

RESOLVED that the Town Board reschedule a Public Hearing on the Laker Development rezoning proposal for the northeast corner of NYS Route 31 and Wayneport Road on February 12, 2004 at 8:00 p.m.

Senator Nozzolio will be at the Town Hall on Saturday from 2-3 p.m.

Councilperson Maul purchased a black and white laser printer for the Building & Zoning Office and will be connected to a server to enable anyone on the network to use.

Councilperson McEwen reviewed items of interest from the Newly Elected Officials School he recently attended.

The Library Board will be asking for an increase of funding from the Palmyra-Macedon School District along with the Palmyra Kings Daughters Library.
