PLANNING BOARD
November 9, 2015
PRESENT: Chairman Doug Allen and members Suzanne Airy, Mert Bartels, Mark McEwen, Tom Morrison, Kevin Rooney and Greg Whitney. Also present were Town Councilman David McEwen, Town Engineer Scott Allen and Board Clerk Susan Bush
Chairman Allen called the meeting to order at 7:30 p.m. A motion to waive reading the Legal Notice was made by Kevin Rooney, seconded by Tom Morrison. All in favor; motion carried.
PUBLIC HEARINGS:
PB-13-15 Cicero Farmington/Victor Roads Single-family residential site plan A motion to open the public hearing was made by Kevin Rooney, seconded by Suzanne Airy. All in favor; motion carried. Applicant Richard Cicero and engineer William Grove were present to address the Board. There was no one else to speak regarding this application. A motion to close the public hearing was made by Kevin Rooney, seconded by Tom Morrison. All in favor; motion carried.
PB-14-15 Waste Management/Packard Quaker Road & Route 31F Realty subdivision A motion to open the public hearing was made by Kevin Rooney, seconded by Tom Morrison. All in favor; motion carried. Jeff Richardson and Nicole Fornof from Waste Management and engineer Dan Savage of Passero Associates were present to address the Board. Property owner Cy Packard was also present. There was no one else to speak regarding the application. A motion to close the public hearing was made by Kevin Rooney, seconded by Tom Morrison. All in favor; motion carried.
OLD BUSINESS:
PB-13-15 Cicero Farmington/Victor Roads Single-family residential site plan Preliminary & final This application is for a single-family residence on a 40+ acre parcel. Town Engineer found the plans to be acceptable. A motion for negative SEQR declaration was made by Mert Bartels, seconded by Kevin Rooney. All in favor; motion carried. A motion was made by Mert Bartels, seconded by Greg Whitney, to grant preliminary & final site plan approval for a single-family residence as submitted in the application. All in favor; motion carried.
NEW BUSINESS:
PB-14-15 Waste Management/Packard Quaker Road & Route 31F Realty subdivision Preliminary & final Dan Savage of Passero Associates and Jeff Richardson, District Manager of Waste Management, addressed the Board. Waste Management is purchasing the Packard farm. The property encompasses four (4) parcels for a total of 197 acres. Of this, the Packard family will retain approximately 23 acres on Route 31F to continue their farming operation with Waste Management owning the remaining 174 acres. Waste Management would like to use the southwestern portion of the property to place clean fill material which will be excavated during the opening of new cells at the landfill. There would be no landfilling operation on this property. The fill will be placed around an existing drumlin and would not go any higher in elevation than the drumlin. Waste Management also plans to construct a shooting range adjacent to the drumlin to accommodate the Fairport and Macedon police departments. Mr. Richardson explained that Cy Packard will remain in the farm house at 281 Quaker Road with a residential lease, and the northeast portion of the property will remain as agricultural use through agreements with the Packard family.
Mr. Richardson also noted that the grading plan submitted (Application PB-15-15) represented 3.1 million cubic yards of material to be moved over the 40-year life of all new cells in Phase 2 of the landfill. The opening of a new cell in Macedon is contingent upon getting the EPA Air Permit, possibly late 2017. Cells are 5-10 acres in size and built in increments, each increment lasting 2-3 years. The filling operation could begin in late 2016 or early 2017.
A motion for negative SEQR declaration for the realty subdivision was made by Tom Morrison, seconded by Mert Bartels. All in favor; motion carried. A motion was made by Tom Morrison, seconded by Kevin Rooney, to grant preliminary and final approval for the realty subdivision as submitted in the application. All in favor; motion carried.
PB-15-15 Waste Management Quaker Road Grading/fill The Board then continued the discussion from the previous application, covering the following points regarding the proposed fill operation:
· Equipment to be used to transport fill across Quaker Rd. (40-ton off-road trucks)
· Traffic control & safety issues
· Number of road crossings per day; damage to Quaker Road
· Possible road closure
· Pad for future power generation operation
· Berm along Quaker Road
· Run-off from site
The Town Engineer noted this proposal will need input from the Town Board and the Highway Department. He will put together comments and questions for the applicant. It was also recommended that a traffic count be taken on that portion of Quaker Road.
OTHER BUSINESS:
Town Engineer Scott Allen explained there is a conflict between our submission date for applications and the County Planning Boards deadline. He suggested changing the Planning Board meeting dates to the first & third Mondays of the month instead of the current second & fourth with the submission date rescheduled accordingly. The Board members had no objections. Mr. Allen will refer this to the Town Board for a change in the Town Code.
MINUTES:
A motion was made by Kevin Rooney, seconded by Mark McEwen, to approve the 09-14-15 minutes with the following amendment to be added to the second paragraph: A motion to waive reading the Legal Notice was made by Kevin Rooney, seconded by Suzanne Airy. All in favor (Allen, Bartels, Whitney absent); motion carried. All in favor; 09-14-15 minutes approved as amended.
A motion was made by Mert Bartels, seconded by Mark McEwen, to approve the 10-12-15 minutes. All in favor; 10-12-15 minutes approved.
