PLANNING BOARD
July 29, 2013
PRESENT: Chairman Doug Allen and members Suzanne Airy, Mert Bartels, Tom Morrison, Kevin Rooney and Greg Whitney. Also present were Town Engineer Scott Allen and Board Clerk Susan Bush. Absent were Mark McEwen and Town Councilman David McEwen.
Chairman Allen called the meeting to order at 7:30 p.m. A motion to waive reading the Legal Notice was made by Kevin Rooney, seconded by Greg Whitney. All in favor (M. McEwen absent); motion carried.
PUBLIC HEARING:
PB-09-13 – Buckley – 1053 Erie Street Road – One-lot realty subdivision & residential site plan – A motion to open the public hearing was made by Kevin Rooney, seconded by Mert Bartels. All in favor (M. McEwen absent); motion carried. Applicants Gerard and Judith Buckley were present along with their representative Tim Vollinger from John A. Greene & Associates. There was no one else present to speak for or against this application. A motion to close the public hearing was made by Kevin Rooney, seconded by Mert Bartels. All in favor (M. McEwen absent); motion carried.
OLD BUSINESS:
PB-09-13 – Buckley – 1053 Erie Street Road – One-lot realty subdivision & residential site plan – Preliminary & final – Tim Vollinger of John A. Greene & Associates reviewed this application for the Board. The Buckleys own a 30+ acre parcel on the corner of Erie Street & Cockle Roads, and they would like to subdivide 9.9 acres on the Cockle Road side to build a new home (single story, 3 bedrooms). The remaining 20.3 acres and existing home would be sold to their daughter & son-in-law. Mr. Vollinger then reviewed the perc test results and driveway sight distances; both meet required standards. A motion for negative SEQR declaration was made by Mert Bartels, seconded by Greg Whitney. All in favor (M. McEwen absent); motion carried. A motion was made by Kevin Rooney, seconded by Suzanne Airy, to grant preliminary/final one-lot subdivision and residential site plan as submitted. All in favor (M. McEwen absent); motion carried.
NEW BUSINESS:
PB-10-13 – Baker – Wilson Road – One-lot realty subdivision – Log-in – This subdivision would allow the transfer of a 30 ft. strip of land between neighboring parcels.
PB-11-13 – Canal Properties I, LLC – 280 Route 31 – One-lot realty subdivision & change of use – Log-in – Applicant would like a change of use (old roller rink to retail) and subdivision along the line of the driveway which bisects the property.
ZBA REFERRAL:
Z-08-13 – Gascon – 3272 Hance Road – Area Variance – Section 135-162-B – Expansion of a non-conforming building – Applicant would like to build a garage addition to his home, which is non-conforming due to less than required front setback. Board gave a positive referral.
MINUTES:
A motion to approve the 07-08-13 minutes was made by Mert Bartels, seconded by Suzanne Airy. All in favor (M. McEwen absent); minutes approved.
