PLANNING BOARD

August 8, 2011

 

 

PRESENT:  Chairman Doug Allen, members Suzanne Airy, Mert Bartels, Mark McEwen, Tom Morrison and Greg Whitney.  Also present were Town Councilman David McEwen, Town Engineer Scott Allen and Board Clerk Susan Bush.  Absent was Kevin Rooney.

 

Chairman Allen called the meeting to order at 7:30 p.m.  A motion to waive reading the Legal Notice was made by Mert Bartels, seconded by Tom Morrison.  All in favor; motion carried.

 

PUBLIC HEARINGS:

 

PB-06-11 – Marcucci2775 Canandaigua Road – One-lot subdivision & single-family residential site plan – A motion to open the public hearing was made by Greg Whitney, seconded by Tom Morrison.  All in favor; motion carried.  Fred Shelley of Shelley Associates was present on behalf of the applicant.  There was no one else to speak for or against this application.  A motion to close the public hearing was made by Greg Whitney, seconded by Tom Morrison.  All in favor; motion carried.

 

PB-07-11 – Waste Management (High Acres) – 1965 Wayneport Road – Site plan approval (recycling transfer station & shooting range) – A motion to open the public hearing was made by Suzanne Airy, seconded by Mert Bartels.  All in favor; motion carried.  Luann Meyer of Barton & Loguidice was present on behalf of the applicant.  At the request of a resident in attendance, Ms. Meyer gave an overview of the project.  Waste Management is proposing a 14,000 sq. ft. building (block walls/steel frame/fabric cover) for consolidation of residential recyclables collected in Wayne County.  These materials will then be transported to a Waste Management facility in Liverpool, NY.    They expect 5 to 7 residential collection trucks per day will drop off material, with one large tractor-trailer a week transferring the material to Liverpool.  In addition, loads of trash containing a high amount of recyclables will be sorted at the facility; garbage will be removed to the landfill and recyclables will be comingled for transfer.  The Wayneport Road driveway will be used as an entrance only, with all trucks exiting through the landfill onto Perinton Parkway.  Site distances were included in the final submission. 

 

The proposed shooting range will be used by the Macedon and Fairport Police Departments only.  Shooting will be directed north into the drumlin with 8-10 ft. earthen berms on each side.  Range will be located approximately 1200-1400 ft. from the canal.

 

There was no one else to speak for or against this application.  A motion to close the public hearing was made by Suzanne Airy, seconded by Mert Bartels.  All in favor; motion carried.

 

PB-08-11 – SanzottaWest Walworth Road – Single-family residential site plan – A motion to open the public hearing was made by Mark McEwen, seconded by Greg Whitney.  All in favor; motion carried.  Greg McMahon of McMahon LaRue Associates was present on behalf of the applicant.  At the request of two residents, Mr. McMahon gave an overview of the project.  This is a 6+ acre parcel (Lot #1, Forsay subdivision), which was given sketch plan approval in 2006 for a single-family residence.  Application was dropped prior to preliminary/final approval.   Mr. McMahon has done all of the design work for both the previous and current applicants.  Perc test has been done; setback for residence will be similar to the surrounding houses (130+ ft.).  In response to a resident’s question, Mr. McMahon stated there were no plans to clear the existing trees along the road.  There was no one else to speak for or against this application.  A motion to close the public hearing was made by Suzanne Airy, seconded by Mert Bartels.  All in favor; motion carried.

 

OLD BUSINESS:

 

PB-06-11 – Marcucci2775 Canandaigua Road – One-lot subdivision & residential site plan – Preliminary & final – Due to a personal conflict, Suzanne Airy recused herself from the discussion and voting.  Fred Shelley of Shelley Associates reviewed this application.  The existing house and garage with one acre will be subdivided from this 17+ acre parcel.  On the remaining acreage a new single-family residence will be constructed to the north of two existing barns (which are to be demolished).  When questioned, Mr. Shelley stated the applicant does not intend to bury the demolition debris on the site.  However, the Board members felt that if the plan changes and debris is buried, the disposal site(s) must be marked on the plans for future reference.  A motion for negative SEQR declaration was made by Tom Morrison, seconded by Greg Whitney.  All in favor (Airy recused; Rooney absent); motion carried.  A motion was made by Tom Morrison, seconded by Greg Whitney, to grant preliminary/final subdivision and residential site plan approval with the conditions that barns marked to be demolished are removed before the Certificate of Occupancy is issued for the future residence and any buried demolition debris is to be mapped for future reference.  All in favor (Airy recused; Rooney absent); motion carried.

 

PB-08-11 – SanzottaWest Walworth Road – Single-family residential site plan – Preliminary and final – A motion for negative SEQR declaration was made by Mert Bartels, seconded by Greg Whitney.  All in favor (Rooney absent); motion carried.  A motion to grant preliminary/final site plan approval was made by Tom Morrison, seconded by Greg Whitney.  All in favor (Rooney absent); motion carried.

 

PB-07-11 – Waste Management (High Acres) – 1965 Wayneport Road – Site plan approval (recycling transfer facility & shooting range) – Preliminary & final -  Luann Meyer of Barton & Loguidice stated they had reviewed the site distances on Wayneport Road and determined the Wayneport Road driveway would be used as an entrance only due to the speed limit (55 mph) and hill just north of the driveway.  All traffic will exit through the landfill onto Perinton Parkway.  Setbacks for the transfer facility and shooting range had been reviewed and will meet the zoning requirements.  Applicant will also be merging the various parcels. 

 

The Board and Ms. Meyer reviewed the Wayne County Planning Board’s response:  (1) No other permits beyond local are required.  Ms. Meyer contacted NYS DEC, and no permit modification is necessary.  (2) Host community agreement is not applicable to this.  Truck traffic of one 18-wheel trailer truck per week does not warrant an impact fee.  Drop-off trucks are 10-wheel trucks used for residential pick up.  (3) Large trucks are required to use state roads.  (4) Both facilities will not be visible from the canal due to a wooded area.  (5) Noise from the shooting range will be governed by the Town’s noise ordinance.  It will be a daylight activity; no artificial lighting.  In addition, Ms. Meyer stated the shooting range is a community service gesture on the part of Waste Management.  The range will eliminate the need for local officers travelling to distant shooting facilities.

 

A motion for negative SEQR declaration was made by Mert Bartels, seconded by Mark McEwen.  All in favor (Rooney absent); motion carried.  A motion to grant preliminary & final site plan approval was made by Greg Whitney, seconded by Mark McEwen.  All in favor (Rooney absent); motion carried.

 

PB-01-11 – Beckenbach – 1116 Route 31 – Commercial site plan – Architectural changes – Jim Beckenbach was present to discuss proposed exterior changes for his project.  Due to cost considerations, he would like to use horizontal vinyl siding and cultured stone on the front, east & west elevations of the building and architectural shingles on the front roof.  The color of the pole barn in the back will change to match the color of the siding.  Mr. Beckenbach brought samples of the products/colors for the Board’s review.  Main color of the building will be “hickory moss”, and roof will be dark gray.  The vinyl siding will wrap around on the east & west elevations, and the cultured stone will be carried around the sides of the front building and the connector section.  The pole barn will have dark gray metal roofing.  These changes will give the building a more residential look.  A motion was made by Greg Whitney, seconded by Suzanne Airy, to modify the site plan approval with the following changes:  (1) Roof on front building to have architectural shingles; (2) Brick on front building will change to cultured stone; (3) Vertical metal siding will change to horizontal vinyl siding on the front, east & west elevations; (4) Colors on rear building will be dark charcoal and “hickory moss”.  All in favor (Rooney absent); motion carried.

 

ZBA REFERRAL:

 

Z-07-11 – DePuy1248 Wayneport Road – Area Variance – Section 135-162-B, Expansion of non-conforming building & Section 135 Schedule I, Side setback – Board gave a positive referral.

A motion to approve the 07-11-11 minutes was made by Mert Bartels, seconded by Suzanne Airy.  All in favor; minutes approved.
