TOWN OF MACEDON

PLANNING BOARD

December 13, 2010

 

 

PRESENT:  Chairman Doug Allen, members Suzanne Airy, Mert Bartels, Mark McEwen, Tom Morrison, Kevin Rooney and Greg Whitney.  Also present were Town Councilman David McEwen, Town Engineer Scott Allen and Board Clerk Susan Bush.

 

Chairman Allen called the meeting to order at 7:30 p.m.  A motion to waive reading the Legal Notice was made by Kevin Rooney, seconded by Mert Bartels.  All in favor; motion carried.

 

PUBLIC HEARINGS:

 

PB-11-10 – Pulcini (Rudovitz) – Kittering/West Walworth Roads – Single-family residential site plan – A motion to open the public hearing was made by Kevin Rooney, seconded by Mert Bartels.  All in favor; motion carried.  David Pulcini, Jr. and David Pulcini, Sr. were present to explain this application.   There was no one else to speak for or against the application.  A motion to close the public hearing was made by Kevin Rooney, seconded by Mert Bartels.  All in favor; motion carried.

 

PB-12-10 – Keller – 815 Quaker Road – One-lot realty subdivision – A motion to open the public hearing was made by Kevin Rooney, seconded by Mert Bartels.  All in favor; motion carried.  Applicant Joseph Keller was present to explain his request.  There was no one else to speak for or against this application.  A motion to close the public hearing was made by Kevin Rooney, seconded by Mert Bartels.  All in favor; motion carried.

 

OLD BUSINESS:

 

PB-11-10 – Pulcini (Rudovitz) – Kittering/West Walworth Roads – Single-family residential site plan – Preliminary & final – Applicant David Pulcini, Jr., presented a revised site plan showing the requested landscaping details.  Trees will be evergreens with some hardwoods near the proposed driveway.  The Town Engineer advised the applicant of the existence of farm drainage tiles on the property.  One known tile may be in the area of the septic system.  If encountered during excavation, tiles must be remediated.  He also stated the Town will be cleaning the ditch along Kittering Road.  The Highway Supervisor has indicated they will need 40 ft. of pipe (24” diameter) for this property.  A motion for negative SEQR declaration was made by Kevin Rooney, seconded by Tom Morrison.  All in favor; motion carried.  A motion to grant preliminary & final residential site plan approval was made by Kevin Rooney, seconded by Tom Morrison.  All in favor; motion carried.

 

PB-12-10 – Keller – 815 Quaker Road – One-lot realty subdivision – Preliminary & final – Applicant Joe Keller explained a revision to his original request.  He would like to increase the road frontage for Lot #2 from 25 ft. to 30 ft. to allow separate access for both lots.  By increasing Lot #2’s frontage, Lot #1 will require a variance for the side setback of the existing building (70 ft. actual vs. 75 ft. required).  An application has been made to the Zoning Board of Appeals for the necessary variance.  If the variance is not granted, Mr. Keller will revert to the 25 ft. frontage on Lot #2 with shared access between the lots.  The applicant intends selling Lot #1 and eventually building a new facility on Lot #2.  Board members were in favor of separate access for each of the lots, avoiding future problems that could arise with shared access.  A motion for negative SEQR declaration was made by Mert Bartels, seconded by Greg Whitney.  All in favor; motion carried.  A motion was made by Kevin Rooney, seconded by Mark McEwen, to grant preliminary & final realty subdivision approval, contingent upon a variance being granted by the Appeals Board.  All in favor; motion carried.

 

In conjunction with the subdivision application, the Board reviewed the ZBA application for Keller (Z-07-10 – 815 Quaker Road – Area Variance – Section 135 Schedule I – Side setback) – A motion was made by Kevin Rooney, seconded by Mert Bartels, for a positive referral to the ZBA.  All in favor; motion carried.

 

OTHER BUSINESS:

 

Waste Management – Wayneport Road – Cindy Jessop and Jeff Richardson from Waste Management were present to review landscaping improvements made along Wayneport Road during 2010.    Ms. Jessop then reviewed the work to date.  In 2008 the berm along Wayneport Road was installed.  In 2009, the first phase of planting was done with evergreen and deciduous trees.  During 2010 additional trees were planted on the north end of the property and around the existing cemetery, and previous plantings which had not survived were replaced.  In 2011 additional plantings will be intermixed among the existing trees.  Waste Management is working with a landscape architect to coordinate this project.  Technical difficulties prevented a video presentation; however, hard copy documentation will be provided for the file.

 

Mr. Richardson then reviewed other items pertaining to the landfill.  Waste Management is considering building a recyclables transfer shed.  This would be a 3-sided shed where local collection trucks would drop recyclables.  The material would then be transferred via larger trucks to their processing facility in Liverpool, NY.

 

TOWN BOARD REFERRAL:

 

RZ-01-10 – AEY/P & B Development – Macedon Center Road – Rezoning AR-40 to ORM – This piece of business was rescheduled for the January 10, 2011, meeting to allow the applicant to have a representative present.

 

ZBA REFERRALS:

 

Z-06-10 – Beckenbach (Newcomb Oil) – 1116 Route 31 – Area Variance – Sections 135-162-B & 135 Schedule I – Expansion of non-conforming building & front setback – Board gave no opinion due to lack of information about this project.

 

Z-07-10 – Keller – 815 Quaker Road – Area Variance – Section 135 Schedule I – Side setback – See Keller action previously noted in minutes.

 

Z-08-10 – Hyde – 811 Turner Road – Area Variance – Section 135-61-B-3 – Accessory structure larger than primary structure – Board gave a positive referral; suggested closed sides on structure instead of open.

A motion to approve the 11-08-10 minutes was made by Mert Bartels, seconded by Suzanne Airy.  All in favor; motion carried.
