PLANNING BOARD

May 11, 2009

 

 

PRESENT:  Chairman Doug Allen, members Suzanne Airy, Merton Bartels, Brian Gagne, Mark McEwen, Tom Morrison and Kevin Rooney.  Also present were Town Councilwoman Sandy Pagano, Town Engineer Scott Allen and Board Clerk Susan Bush.

 

A motion to waive reading the Legal Notice was made by Mert Bartels, seconded by Kevin Rooney.  All in favor; motion carried.

 

PUBLIC HEARINGS:

 

PB-03-09 – Sapp – 2891 Route 350 – Single-family residential site plan – A motion to open the public hearing was made by Brian Gagne, seconded by Kevin Rooney.  All in favor; motion carried.  Applicant Fred Sapp was present to explain his application.  There was no one else present to speak for or against this application.  A motion to close the public hearing was made by Kevin Rooney, seconded by Brian Gagne.

 

PB-04-09 – Home Leasing – Hance Road – Two-lot realty subdivision & single-family residential site plans – A motion to open the public hearing was made by Brian Gagne, seconded by Kevin Rooney.  All in favor; motion carried.  Jeff Leenhouts of Home Leasing and Linc Swedrock of BME Associates were present to explain this application.  A Hance Road resident had questions regarding the elevation of the proposed houses in relation to the road and the existing drainage pond.  Mr. Swedrock explained the lots do slope up from front to back, and the houses will be above road grade.  However, he felt they would not be higher than the existing house to the south.  The water quality pond on the corner of Lot 2 will remain and drainage easements will be requested for both lots.  There was no one else present to speak for or against the application.  A motion to close the public hearing was made by Brian Gagne, seconded by Mert Bartels.  All in favor; motion carried.

 

PB-05-09 – Crane – Alderman Road – One-lot realty subdivision & single-family residential site plan – A motion to open the public hearing was made by Kevin Rooney, seconded by Mert Bartels.  All in favor; motion carried.  Applicant Gary Crane and his son were present to explain this application.  There was no one present to speak against this application.  A motion to close the public hearing was made by Kevin Rooney, seconded by Mert Bartels.  All in favor; motion carried.

 

OLD BUSINESS:

 

PB-03-09 – Sapp – 2891 Route 350 – Single-family residential site plan – Preliminary & final – Proposed house will be just north of the house Mr. Sapp is currently building on Route 350.  Required trees are not shown on the plan, but will be noted on the building permit.  The house will be located toward the rear of the lot with drainage swales along both side property lines.  A motion for negative SEQR declaration was made by Brian Gagne, seconded by Kevin Rooney.  All in favor; motion carried.  A motion to grant preliminary/final site plan approval was made by Brian Gagne, seconded by Kevin Rooney.  All in favor; motion carried.

 

PB-04-09 – Home Leasing – Hance Road – Two-lot realty subdivision & single-family residential site plans – Preliminary & final – Linc Swedrock of BME Associates reviewed this proposal for the southeast corner of Hance Rd. and Evergreen Hill Drive.  Design is consistent with sketch approval and changes requested at that time.  The houses are 80 ft. off the road; both driveways are on Hance Road; driveways will be paved; existing water quality pond will remain with easements across the front of both lots; sewer lay-out has been agreed upon.  Engineering comments have been provided to the developer.  A motion for negative SEQR declaration was made by Brian Gagne, seconded by Kevin Rooney.  All in favor; motion carried.  A motion was made by Brian Gagne, seconded by Kevin Rooney, to grant preliminary/final subdivision & site plan approval subject to recommendations made regarding drainage, sewer, driveways and engineering comments.  All in favor; motion carried.

 

PB-05-09 – Crane – Alderman Road – One-lot realty subdivision & single-family residential site plan – Preliminary & final – Board member Tom Morrison recused himself from all discussion and/or voting on this matter.  The applicants are subdividing their property (14.36 acres) to enable their son to build a home on the new lot (2.488 acres).  The Town Engineer questioned the water service alignment, and the applicant explained this configuration would allow easier access during installation due to the slope of the property.  A motion for negative SEQR declaration was made by Mert Bartels, seconded by Kevin Rooney.  All in favor (T. Morrison recused); motion carried.  A motion to grant preliminary/final subdivision & site plan approval was made by Kevin Rooney, seconded by Brian Gagne.  All in favor (T. Morrison recused); motion carried.

 

NEW BUSINESS:

 

PB-06-09 – ESL Federal Credit Union – Gananda Parkway & Canandaigua Road – One-lot realty subdivision & commercial site plan – Sketch – John Stapleton of Marathon Engineering and Joe Burkhart of ESL were present to explain this proposal for the subdivision of a 1.0 acre lot to be used for a dual-lane bank ATM.  Access will be from Canandaigua Road only.  Site lighting will be shoebox fixtures on 20 ft. poles with no light spillage off the property.  Building will be brick with gabled roof.  Low plantings will be done around the foundation, with trees planted on the site away from the building.  There will be one building-mounted sign located on the Canandaigua Road side to identify the facility.  No ground signs will be used other than directional signs.  Water service will be installed for landscape irrigation purposes only.  SWPPP plan is not needed as less than one acre will be disturbed.  Mark McEwen suggested additional landscaping along the corner of Gananda Parkway & Canandaigua Road, something low that will not obstruct the intersection.  The Town Engineer requested traffic count documentation.  A motion for sketch plan approval was made by Brian Gagne, seconded by Kevin Rooney.  All in favor; motion carried.

 

PB-09-09 –ESL Federal Credit Union – Macedon Commons Plaza – Commercial site plan – Sketch – In addition to the Gananda Parkway/Canandaigua Road location, ESL is proposing another dual-lane bank ATM at the corner of Canandaigua Road & Route 31 in the Macedon Commons Plaza.  This is an existing .53 acre parcel next to Burger King.  Access from Canandaigua Road was originally proposed; however, the design has been changed with access now coming through Macedon Commons Plaza parking lot similar to Burger King.  There will be one building-mounted sign identifying the facility on the Route 31 side; no monument sign is planned.  Additional landscaping on the Canandaigua Road/Route 31 corner was requested by the Board.  A motion to grant sketch plan approval was made by Brian Gagne, seconded by Kevin Rooney.  All in favor; motion carried.

 

PB-11-09 – Doyle – 1772 Magog Road – Home occupation – Applicant Marie Doyle was present to explain this request.  She would like to begin a home educational business of individual tutoring and small group instruction, especially during the summer season.  She has a ranch home with a walk-out basement.  A 22 ft. x 18 ft. finished room in the basement would be utilized for this purpose.  Students would be dropped off by their parents and picked up after their session.  She would offer classes during the day (1-2 hr. duration), as well as evening homework sessions.  Ms. Doyle stated licensing by NY State is not required for this service.  She anticipates 4-12 students in a class with a half-hour interval between classes.  The existing driveway would accommodate necessary parking and allow for vehicles to turn around and drive out.  Tom Morrison had concerns about entrance/exit from the classroom area during winter months.  Ms. Doyle explained there is an existing sidewalk between the walk-out door and the driveway.  Emergency exits/lighting was discussed.  The Fire Marshal will have to do a safety inspection of the premises.  A motion to approve this home occupation subject to a safety inspection was made by Kevin Rooney, seconded by Mert Bartels.  All in favor; motion carried.

 

OTHER BUSINESS:

 

PB-10-09 – Alpco – 846 Route 31F – Renewal of fill permit – Al Plumb, Jr., was present to explain this request.  Alpco is still filling the same area along Wilcox Road; footprint has not changed from original submission.  Mr. Plumb felt area is approximately 40% filled, and it may take several years to reach 100% as availability of fill has slowed substantially.  A motion to grant a two-year extension on the fill permit was made by Brian Gagne, seconded by Kevin Rooney.  All in favor; motion carried.

 

Village of Macedon Referral – Palmiere – East Main Street – Site plan & electronic sign – This action was sent to the Planning Board for an advisory referral.  Subject property is within 500 ft. of the common municipal boundary.  Proposal is for the subdivision of a 50’ x 60’ parcel from the existing sewage treatment plant property to be used for a digital billboard.  In exchange, the Village would receive two lots adjacent to Gravino Park to be used for park expansion.  The billboard would be double-sided; approx. 280 sq. ft. each side; 24 ft. high.  Discussion included character of the neighborhood, content of the sign, environmental concerns regarding the parcels to be used for park expansion.  A motion was made by Brian Gagne, seconded by Tom Morrison, for a negative referral due to (1) Sign would not enhance the character of the neighborhood; (2) Content of the sign could not be controlled (proximity to the public park); (3) Environmental concerns about the property proposed to be given to the Village for park expansion.  All in favor; motion carried.

 

MINUTES:

 

A motion to approve the 04-27-09 minutes was made by Mert Bartels, seconded by Kevin Rooney.  All in favor; minutes approved.
