PLANNING BOARD
February 14, 2005
PRESENT: Chairman Doug Allen, members Mert Bartels, Brian Gagne, Mark McEwen, Tom Morrison and Kevin Rooney. Also present were Councilman Ken Nawrocki, Town Engineer Scott Allen and Town Attorney Anthony Villani. Absent was Tom Ferreri.
Chairman Allen called the meeting to order at 7:31 p.m. Motion to open the meeting made by Brian Gagne, seconded by Kevin Rooney. All in favor; motion carried. Motion made by Mert Bartels, seconded by Brian Gagne, to waive reading the legal notice as it appeared in the Times. All in favor; motion carried.
Doug Allen then explained the Board would address the VerDouw application immediately following its public hearing, after which they would conduct the public hearing on Wal-Mart.
PUBLIC HEARING:
PB-01-05 – VerDouw – 2345 Barnes Road – One-lot realty subdivision – Motion made by Brian Gagne, seconded by Mert Bartels, to open the public hearing. All in favor; motion carried. Applicant Ronald VerDouw was present to explain his request. No one else was present to speak for or against this application. Motion to close the public hearing made by Brian Gagne, seconded by Kevin Rooney. All in favor; motion carried.
NEW BUSINESS:
PB-01-05 – VerDouw – 2345 Barnes Road – One-lot realty subdivision – Ronald VerDouw has an 18+ acre parcel and would like to subdivide 1.7 acres to be sold to an adjoining neighbor (Bosch). This new lot would be merged with the current Bosch parcel. Mr. VerDouw asked if this would be considered a saleable lot should the Bosch purchase not go through. Dimensions of the lot (150' x 545') meet zoning requirements; however, it would not be an approved building lot. Motion for negative SEQR declaration made by Kevin Rooney, seconded by Brian Gagne. All in favor; motion carried. Motion made by Tom Morrison, seconded by Kevin Rooney, to approve a one-lot realty subdivision with Lot 2 to be combined with the Bosch property upon ownership transfer. All in favor; motion carried.
PUBLIC HEARING:
PB-31-04 – Wal-Mart Supercenter/APD Engineering – Northeast corner Wayneport Road & NYS Rt. 31 – Preliminary site plan, subdivision, environmental impact assessment report – Motion made by Mert Bartels, seconded by Mark McEwen, to open the public hearing. All in favor; motion carried. Present on behalf of the applicant were: Neal Madden, Harter, Secrest & Emery; Steve Cleason, APD Engineering; Ray Trotta, Bergmann Associates; and Amy Dake, SRF & Associates.
Mr. Madden submitted confirmation the legal notice had been published in the Times.
Steve Cleason then gave a project overview, including location, zoning, special use and variances required. There will be four (4) distinct parcels: Wal-Mart store, gas station, dedicated road and balance of the property (retained by developer). Main site will contain a 204,918 sq. ft. store with 1,008 parking spaces. Public water & sewer are available. Site includes a 50 ft. right-of-way for a high-pressure gas main and a 300 ft. right-of-way for the overhead high-power electric lines. A 16" water main crossing the property will be relocated to one side. A special use permit will be required for the gas station, and variances will be needed for street setbacks at the gas station and rear of the supercenter. A change from eight (8) gas pumps to five (5) has reduced the front setback variance being requested.
Storm water management, water detention, wetland mitigation, landscaping and berms along Route 31 were explained. A lighting plan has been provided to the Planning Board. Wal-Mart representatives are working with the neighbors along Route 31 and Immanuel Drive to address their concerns. A traffic signal at the Route 31 entrance will provide safer exit from Immanuel Drive. Traffic studies have been done with projections of "new trips" to be generated. Left turn lanes and a westbound right turn lane will be added to Route 31. Shoulder improvements will be made on Wayneport Road.
Ray Trotta of Bergmann Associates then presented the latest elevations. As a result of the recent workshop with town and community representatives, the plan has been modified to include quik brik, metal cladding, "up" lighting through wall sconces, green accent coloring and removal of accent color behind front sign. Building will be brick on all sides. Sidewalk material has been changed to show more delineation, and garden center has brick piers between wrought iron fence sections.
PUBLIC COMMENT:
Jim Finn, owner of ExxonMobil station, 337 Route 31 – Mr. Finn objected to the reference to northeast corner in public/legal notices. He would like clarification that his business is the real northeast corner.
Jason Cole, 1385 Wilson Road – Mr. Cole asked what type of road signs would be installed and the type of gas station.
Jim Reisdorf, Information Packaging, 1670 Wayneport Road – Mr. Reisdorf expressed concern regarding traffic on Wayneport Road and asked if the County Highway Department was involved. He also felt the current bridge over the canal would be inadequate for the traffic to be generated.
Darrel Salisbury, 1460 Wilson Road – Mr. Salisbury had concerns about the speed and traffic flow on Wilson Road. He would like to see a lower speed limit and more enforcement. Also, he felt it would be difficult to turn onto Route 31 without a traffic light at Wilson Road.
Bill Moore, 306 Macedon Center Road – Regarding Wayneport Road/Route 31, he would like to see a breakdown of the traffic numbers on the north/south roads.
Al Vespucci, 1525 Immanuel Drive – Mr. Vespucci is the representative for residents on the south side of Route 31. They have several concerns regarding safety, security, property values, traffic impact, noise, lighting, air quality (Route 31 traffic) and road expansion, and a list of these was given to the Board.
Sandy Korhumel, 1385 Wilson Road – Ms. Korhumel questioned traffic impact on Wilson Road. She would like to see a traffic light installed.
Jim Finn, ExxonMobil, 337 Route 31 – Mr. Finn asked if tax abatements were being offered to Wal-Mart. Scott Allen responded that none had been requested. However, Mr. Madden stated there is the possibility of the 485-b tax program which is available to all new businesses and has a 10-year declining exemption percentage.
Jason Cole, 1385 Wilson Road – Mr. Cole had concerns about storm water/surface water management from Wilson Road.
Glenn Roat, 1297 Wilson Road – Mr. Roat had questions regarding number & source of delivery trucks.
Wayne Fox, 1275 Wilson Road – Mr. Fox asked how far east along Route 31 could be commercially developed, prospects for that area and plans for extension of the access road, possibly to exit at Wilson Road. Mr. Nawrocki explained the Town's Master Plan provides for roadways in that area. Scott Allen stated the General Commercial zoning goes to the eastern property boundary of the old Long farm (east of Wilson Road), and there are no applications at this time.
Ann Schauman, 1206 Nolan Road – Ms. Schauman felt that Wal-Mart's entry in a small community results in the failure of small stores & businesses. She also does not agree with Wal-Mart's hiring & employment practices. Ms. Schauman cited West Wayne Plaza as an eyesore with the empty Ames store, as well as Macedon Commons with a major vacancy (CVS). She questioned the survival of P&C and Finn's ExxonMobil. Chairman Allen responded that Finger Lakes Community College is interested in the Ames location, and Scott Allen explained the old CVS store is still under lease to CVS and not available for a new tenant.
Shirley Roat, 1297 Wilson Road – Ms. Roat recently visited a Wal-Mart Supercenter (Chili Avenue, Rochester) and felt it was very poorly maintained for a store built in 2001. She suggested the Planning Board members visit other supercenters.
Dave Bassett, 515 Wilkinson Road – Mr. Bassett submitted an e-mail regarding the parking lot lighting and fixtures.
There was no one else present to speak for or against this application. Motion made by Mert Bartels, seconded by Kevin Rooney, to close the public hearing. All in favor; motion carried.
RESPONSE TO COMMENTS:
Steve Cleason reviewed the following points:
Pylon Sign – Sign plan will be submitted to the Planning Board for review & approval. Town Code limits height to 20 ft., and Wal-Mart will work within the Code.
Gas Station – Wal-Mart works independently or with Sunoco. Either way, the colors & style will match the supercenter.
Traffic Report – At this time Wilson Road does not meet the State DOT warrant for a traffic signal. Depending upon future development, it would be a logical entry point with a traffic signal. The traffic studies looked at six intersections, not just Wayneport & Wilson Roads. The NYS DOT would like more information on the Canandaigua Road/Rt. 31 intersection.
Wayneport Road Bridge – Improvements needed due to this or future projects will be discussed with DOT. Scott Allen stated the Town is aware of the situation, and one of the criteria for improvements is having development, such as Wal-Mart, nearby.
Truck Traffic – On average, 3-4 trailer truck deliveries will be made over 24 hrs., increasing to 7-8 during the holiday season. Additionally, there could be 10-15 smaller vehicles making deliveries with pop, bread, milk, etc.
Wilson Road Drainage – Another culvert under Route 31 is a possibility. Scott Allen indicated there is a problem where the old trolley bed crosses Wilson Road, and the Highway Superintendent is working on this.
MINUTES:
Motion to approve the 1-10-05 minutes made by Kevin Rooney, seconded by Tom Morrison. All in favor; minutes approved. The 1-24-05 minutes could not be approved due to lack of the proper quorum.
