PLANNING BOARD
January 10, 2005
PRESENT: Chairman Doug Allen, members Tom Ferreri, Brian Gagne, Mark McEwen, Tom Morrison and Kevin Rooney. Also present were Councilman Ken Nawrocki, Town Engineer Scott Allen and Town Attorney Anthony Villani. Absent was Mert Bartels.
Chairman Allen called the meeting to order at 7:31 p.m. Motion was made by Brian Gagne, seconded by Kevin Rooney, to waive reading the legal notice as it appeared in the Times. All in favor; motion carried.
PUBLIC HEARINGS:
PB-34-04 – Hamlin – 2740 Route 350 – One-lot realty subdivision – Motion to open the public hearing made by Brian Gagne, seconded by Kevin Rooney. All in favor; motion carried. There was no one present to speak for or against this application. Motion to close the public hearing made by Brian Gagne, seconded by Kevin Rooney. All in favor; motion carried.
PB-10-04 – Song – 203 Wilkinson Road – One-lot subdivision & site plan – Single-family residence – Motion to open the public hearing made by Brian Gagne, seconded by Kevin Rooney. All in favor; motion carried.
Peter Robson, 195 Wilkinson Road, was present to speak against this application. Mr. Robson's property adjoins the Song property, and the two share a driveway through an easement to Song (proposed Lot #1). Mr. Robson stated his concerns regarding property values, size of home to be built, orientation of home on Lot #2, continuation of easement to Lot #1, future subdivision of a third lot, unusual shape/size of Lot #1, and changing Lot #1's road access to the proposed driveway for Lot #2.
Dave Matthews, Matthews Consulting, was present on behalf of the applicant. He stated the existing driveway easement for Lot #1 would remain in the event of ownership change. Access to Wilkinson Road for Lot #2 will be through its own driveway farther to the east. At the present time, the Songs have no intention of future subdivision.
There was no one else present to speak for or against this application. Motion to close the public hearing made by Brian Gagne, seconded by Kevin Rooney. All in favor; motion carried.

PB-32-04 – Schmidlin/Coffey – 897 Turner Road – One-lot subdivision & site plan – Single-family residence – Motion to open the public hearing made by Brian Gagne, seconded by Kevin Rooney. All in favor; motion carried. Bob Seeley, Kreiling Associates, was present on behalf of the applicant. There was no one else present to speak for or against this application. OLD BUSINESS:
PB-10-04 – Song – 203 Wilkinson Road – One-lot subdivision & site plan – Single-family residence – Preliminary & final – Sketch approval was granted in June, 2004, contingent upon any prior subdivision restrictions placed on the parcel. No restrictions were found. The parcel subdivision lines have been changed from sketch approval, creating a long "neck" to the rear property line of Lot #1 (existing house). Dave Matthews, Matthews Consulting, explained the owners want to have access to the back via their own land. Both lots will have 15 ft. access to Wilkinson Road with the driveway for Lot #2 on these shared strips. Mr. Matthews stated there was insufficient road frontage (30 ft. for two lots) to allow future subdivision of a third lot. The Town Engineer noted that no further subdivision could be made a condition of the Board's approval. Board members discussed the following concerns: 15-ft. wide "neck" leading to the rear of Lot #1; shared driveway for both lots onto Wilkinson Road; abandonment of current driveway easement for Lot #1 through the Robson property; buffering between Lots #1, #2 and the Robsons; width to depth ratio; septic system location on Lot #1; a drainage swale between Lots #1 & #2. Motion to table this application made by Brian Gagne, seconded by Tom Morrison. All in favor; motion carried. Items to be resolved: (1) Elevation for garage floor of existing house (Lot #1); (2) Drainage swale between Lots #1 & #2; (3) Location of septic system on Lot #1; (4) Possible abandonment of easement between Robson & Lot #1; (5) Reconfiguration of Lot #1.
PB-17-04 – Weber – Daansen Road – Three-lot subdivision & site plan – Single-family residences – Preliminary & final – Dave Matthews, Matthews Consulting, explained layouts have been changed for Lots #2 & #3 since sketch plan approval in July, 2004. Lot #2 is now large enough to accommodate horses, if desired (over 5 acres), has access to the creek and meets perc requirements. However, it violates the 4:1 depth to width ratio and will need a waiver from the Town Board. Lots #1 & #3 are acceptable. Short-form SEQR shows no impacts. Motion for negative SEQR declaration made by Brian Gagne, seconded by Kevin Rooney. All in favor; motion carried. Motion made by Kevin Rooney, seconded by Brian Gagne, to grant preliminary & final approval for three-lot subdivision and residential site plans contingent upon Town Board waiver for width to depth ratio on Lot #2. PB-32-04 – Schmidlin/Coffey – 897 Turner Road – One-lot subdivision & site plan – Single-family residence – Bob Seeley, Kreiling Associates, reviewed the plans. Right-of-way easements for access/utilities and existing trees & hedgerows are now shown on the plan. Water tap and meter sizes need to be shown. Water service will be 1". Proposed driveway needs to be corrected to be entirely on new parcel. Due to lot location & shape, there are two 60 ft. front setbacks. Motion for negative SEQR declaration made by Brian Gagne, seconded by Kevin Rooney. All in favor; motion carried. NEW BUSINESS:
PB-34-04 – Hamlin – 2740 Route 350 – One-lot subdivision – Applicant Mark Hamlin explained his application. He is subdividing a 1.3 acre parcel from his property. Although unapproved as a building lot, a preliminary perc test was done and site distances checked by an independent engineer. The Board advised Mr. Hamlin that any driveway curb cut would need NYS DOT approval (Route 350) and would be required as part of any future site plan approval. Motion for negative SEQR declaration made by Brian Gagne, seconded by Kevin Rooney. All in favor; motion carried. Motion to approve this one-lot subdivision made by Kevin Rooney, seconded by Brian Gagne. All in favor; motion carried.
PB-35-04 – Farley – 1408 Sunrise Drive – Home Occupation – Robert Farley was present to explain his request to operate a tax preparation business. There would be no changes to the exterior of his residence, and the driveway will accommodate six (6) vehicles. According to Mr. Farley, the neighbors have no objections to this proposal. He anticipates one-hour appointments for one client at a time. Chairman Allen requested the applicant to provide written approval from the neighbors (two adjoining & two across the street). Motion made by Brian Gagne, seconded by Kevin Rooney, to grant approval for this home occupation contingent upon receipt of written approval from neighbors. All in favor; motion carried.
ZBA REFERRAL:
Z-16-04 – Flaherty's Three Flags Inn – 113 Route 31 – Area Variance – Sections 135-189-K, 135-190-E, 135-190-F – Size & location of free-standing sign – This application is for an externally lit monument sign located east of Flaherty's restaurant. Currently there is one building mounted sign. A variance is needed for setback from the right-of-way and total square footage. Board consensus for referral: Ferreri – has concerns regarding need for second sign; Gagne – no concerns; McEwen – no concerns; Morrison – no concerns; Rooney – no concerns; Allen – no concerns. Therefore, a positive referral will be made to the ZBA.
ADDITIONAL BUSINESS:
PB-31-04 – Wal-Mart SuperCenter/APD Engineering – Northeast corner Wayneport Road & NYS Rt. 31 – Retail site plan & subdivision – Sketch – Present on behalf of the applicant were: Neal Madden – Harter, Secrest & Emery, Steve Cleason – APD Engineering, and Ray Trotta – Bergmann Associates.
According to Mr. Madden, lead agency notices were sent and responses are coming in. A 12/29/04 meeting was held with the neighbors on Route 31 and Immanuel Drive to review their concerns. Deed copies for involved properties have been obtained for future reference. They will continue to work with the property owners.
Mr. Cleason then began a review of the site plan modifications. The biggest change was separation of the rear roadway from the building; however, one power pole complicates this design. An underground gas transmission line restrains the east access road. Pavement cannot be placed over this line other than "crossings" for driveways. The Route 31 access has been offset to avoid unwanted traffic on Immanuel Drive. Berms around the gas station have been enhanced for buffering. Berms are being considered for the south side of Route 31, as well as fences/gate for Immanuel Drive. Safety/emergency access and location of the gas main on the south side need to be considered.
Engineers will be working with the Army Corps of Engineers on the federal wetland mitigation. Gas station has been moved back as far as possible without intruding on the wetlands. Storm water basins (2) were discussed. Largest basin is off site on the developer's property, and an easement will be required for access/maintenance. This area will not disturb wetlands. Smaller basin is located near the Wayneport Road entrance.
Other items discussed were: Removal of town dedicated road area from site acreage; relocation of water main; extension of sewer district; gas main and power line rights-of-way; grading of front berms; widening of Route 31 & Wayneport Road.
Mr. Trotta presented elevations of the building including a view from Immanuel Drive. Their design takes into consideration other architectural styles in the town, including gable roof over the entrances, darker roof, split-face block, toned-down colors (red brick). Blue is used for sign band only. They do not wish to duplicate another site's building, but make this facility unique to Macedon. Board liked overall design, but details need to be added and/or changed such as lighting, benches, decorations, sidewalks, plantings, emphasize entrances. Mark McEwen requested an elevation from a Wayneport Road perspective.
Tom Morrison expressed concern regarding the rear access road – distance from northwest corner of building and sharp curve. Style of guardrails was also questioned.
Mr. Cleason stated a full submission would be made by January 19th, including traffic study, drainage, wetland delineation, SEQR, lighting & site plan.
Chairman Allen asked for any other concerns prior to sketch plan approval. Members have list of items for preliminary scoping. As presented, the plan meets the requirements for sketch plan approval. Motion made by Brian Gagne, seconded by Kevin Rooney, to grant sketch plan approval. Roll vote was taken as follows: Ferreri – yes; Gagne – yes; McEwen – yes; Morrison – yes; Rooney – yes; Allen – yes. Therefore, this sketch plan is approved.
