PLANNING BOARD MINUTES
April 12, 2004
PRESENT: Chairman Doug Allen, members Brian Gagne, Mark McEwen and Tom Morrison. Also present were Councilman Ken Nawrocki and Town Engineer Scott Allen. Absent were members Mert Bartels, Tom Ferreri and Kevin Rooney.
Chairman Allen called the meeting to order at 7:30 p.m. A motion was made by Brian Gagne, seconded by Mark McEwen, to waive reading the Legal Notice as it appeared in the Times. All in favor; motion carried.
PUBLIC HEARING:
PB-02-04 – Weber – Daansen Road – One lot realty subdivision – Motion made by Brian Gagne, seconded by Mark McEwen, to open the public hearing. All in favor; motion carried. Applicant Emil Weber was present to explain his request. No one else was present to speak for or against this application. Motion made by Brian Gagne, seconded by Mark McEwen, to close the public hearing. All in favor; motion carried.
OLD BUSINESS:
PB-02-04 – Weber – Daansen Road – One lot realty subdivision – With her permission, Mr. Weber is acting on behalf of the present owner, Alma Haak, 2849 Daansen Road, Walworth, NY. This parcel of approximately 57 acres spans both sides of Daansen Road, just south of Haak Road. The subdivision will be along the centerline of the highway with Mrs. Haak retaining the west side portion and Mr. Weber purchasing the east side. Mr. Weber intends to farm this land for at least one year, then possibly subdivide it into 5+ acre parcels. Motion for negative SEQR declaration made by Brian Gagne, seconded by Tom Morrison. All in favor; motion carried. Motion made by Brian Gagne, seconded by Mark McEwen, to grant a one-lot realty subdivision based on negative SEQR declaration. All in favor; motion carried.
TOWN BOARD REFERRAL:
PB-04-04 – Long – Route 31 – Rezoning – Property owner Richard Long and Gary Garofalo of Fisher Associates were present to explain this request. Mr. Long owns two (2) parcels totalling approximately 95 acres on the north side of Route 31 just east of the Wilson Road intersection. It is currently zoned ORM with a change requested to GC in line with the Master Plan proposal. Mr. Long stated the GC classification would make this parcel more desirable for development of retail operations and possible multi-family dwellings at the north edge of the property along the canal. He has had interest in the property, but potential buyers do not want to go through the rezoning process. Discussion followed on zoning categories that allow multi-family units (R-22, GC & TPD). In general the Board felt the GC category allows for both retail and multi-family units, which would be a natural fit. TPD would present a problem of implementing the entire development plan not just selected sections. Rezoning the entire area in line with the Master Plan was also discussed. It was suggested the Master Plan Committee and other effected property owners be included in this process. Motion was made by Brian Gagne, seconded by Mark McEwen, to give the Town Board a positive referral on this rezoning action and advocating implementation of the Master Plan for the northeast corner of Route 31 and Wayneport Road with the other involved property owners. All in favor; motion carried.
MINUTES:
Motion made by Mark McEwen, seconded by Tom Morrison, to approve the 3/22/04 minutes. All in favor; minutes approved.
