PLANNING BOARD MINUTES
December 8, 2003
PRESENT: Chairman Doug Allen, members Mert Bartels, Brian Gagne, Mark McEwen, Tom Morrison and Kevin Rooney. Also present were Councilman Ken Nawrocki and Town Engineer Scott Allen. Absent was member Tom Ferreri.
Chairman Doug Allen called the meeting to order at 7:33 p.m. Motion made by Kevin Rooney, seconded by Mert Bartels, to waive the reading of the Public Notice as it appeared in the Times. All in favor; motion carried.
PUBLIC HEARING:
PB-25-03 – Marvin – Victor Road – Site plan – Single family residence – Preliminary & final – Motion made by Brian Gagne, seconded by Mert Bartels, to open the public hearing. All in favor; motion carried. Applicant Mike Marvin was present. No one else was present to speak for or against this application. Motion made by Brian Gagne, seconded by Mert Bartels, to close the public hearing. All in favor; motion carried.
OLD BUSINESS:
PB-25-03 – Marvin – Victor Road – Site plan – Single family residence – Preliminary & final – This was a 20-acre parcel now divided into two 10 acre lots. Mr. Marvin is selling his house on one of these lots and building a new home on the other. Scott Allen stated the perc test was good and had no other engineering comments. Mr. Marvin stated he will be installing a guardrail along the driveway curve to prevent the possibility of vehicles going off the driveway into the neighbor's pond. Motion for negative SEQR declaration made by Mert Bartels, seconded by Kevin Rooney. All in favor; motion carried. Motion made by Brian Gagne, seconded by Kevin Rooney, to grant preliminary & final approval based on site plans submitted. All in favor; motion carried.
TOWN BOARD REFERRAL:
Todd's Towing – 2938 County Line Road – Special Use Permit – ApplicantTodd Kaplin has an option to purchase a residence on 4.8 acres. He would like to build a pole barn on the property for the storage and maintenance of his tow trucks. Barn will be approximately 40' x 80', store 4-5 trucks and be located behind the residence. There is vacant land on either side of the parcel with muckland/farmland to the rear. No towed/damaged vehicles will be stored on the premises. Board members had concerns regarding placement of the barn doors and fencing to shield the view. Planning Board gave a positive recommendation with the request the barn doors be placed on the rear (east) of the building and adequate fencing be provided to shield the view.
ZBA REFERRALS:
Z-23-03 – Prestige Millwork – 384 East Avenue – Area Variance – Section 135-92 – Front setback – This is a newly constructed building. When the final survey was done, it was discovered a bump-out on the building is 1.7' within the setback (73.3 ft. vs. 75 ft. required). The mortgage company will not give final approval without a variance being granted. Board had no concerns and gave a positive referral.
Z-24-03 – Coomber – Magog Road – Area Variance – Sections 135-61-A, B-3, B-4 – Barn/garage larger & taller than allowed by Code – This is for a pole barn to be used for storage of an RV and other personal vehicles. Building will be 200-250 ft. from the road. Board had no concerns and gave a positive referral.
Z-25-03 – Wyman – 3096 Kittering Road – Area Variance – Section 135-64-G-4 – Lot size – Residential two-family conversion – This lot is approximately 2,000 sq. ft. less than 44,000 sq. ft. required for a residential conversion from one- to two-family. This is a ranch style residence with a walk-out basement. Septic was designed for 4-bedroom home. Board had no concerns and gave a positive referral. It was also noted that planning approval will be required from this Board if the variance is granted by the ZBA.
