PLANNING BOARD MINUTES

October 27, 2003

 

PRESENT: Chairman Doug Allen, members Mert Bartels, Tom Ferreri, Brian Gagne, Mark McEwen, Tom Morrison and Kevin Rooney. Also present were Town Engineer Scott Allen and Councilman Ken Nawrocki.

Chairman Allen called the meeting to order at 7:30 p.m. Motion made by Mert Bartels, seconded by Tom Ferreri, to waive the reading of the Public Notice as it appeared in the Times. All in favor; motion carried.

PUBLIC HEARINGS:

PB-23-03 – Spoon Exhibit Services – Research Forest – Subdivision & site plan - Motion made by Mert Bartels, seconded by Tom Ferreri, to open the public hearing. All in favor; motion carried. Duncan Jackson and Mark Valentine of MRB Associates and Richard LeFrois, LeFrois Builders, were present on behalf of the applicant. No one else was present to speak for or against this application. Motion made by Mert Bartels, seconded by Tom Ferreri, to close the public hearing. All in favor; motion carried.

PB-24-03 – Sigel – 1327 Victor Road – Realty subdivision – Motion made by Mert Bartels, seconded by Tom Ferreri, to open the public hearing. All in favor; motion carried. Bob Seeley of Schwartz Surveying and Edwin Sigel were present to speak for this application. No one else was present to speak for or against this application. Motion made by Mert Bartels, seconded by Tom Ferreri, to close the public hearing. All in favor; motion carried.

NEW BUSINESS:

PB-26-03 – Wasserlauf – 1427 Canandaigua Road – Home Occupation – Karen Wasserlauf, Healthy Touch Wellness Center, presented her proposal for this location. She would like to move her massage therapy office into one portion of this building (presently a tax office) and rent the remaining residential portion. This property is zoned R-30 but surrounded by TPD. Adequate parking was discussed – 6-8 spaces would be necessary to accommodate clients, owner & tenants. Ms. Wasserlauf will be contacting the Highway Supervisor for guidance on driveways/parking. Hours of business would generally be 8:00 a.m. to 5:00 p.m. with occasional evening hours. Property is on septic; condition & room for expansion were questioned. Ms. Wasserlauf is having this inspected & may be looking to purchase additional land from the adjoining property to allow for replacement/expansion of the septic system. Motion to approve this home occupation made by Mert Bartels, seconded by Kevin Rooney. All in favor; motion carried.

OLD BUSINESS:

PB-24-03 – Sigel – 1327 Victor Road – Realty Subdivision – Final – Bob Seeley of Don Schwartz Surveying, explained this proposal. Mr. Sigel would like to transfer 3.1 acres from one parcel to an adjoining parcel now in the process of being sold. Transferred acreage will be merged with existing 1.9 acres, making a total parcel of 5 acres. The parcel being reduced will go from 5.8 to 2.7 acres. Motion for negative SEQR declaration made by Tom Morrison, seconded by Kevin Rooney. All in favor; motion carried. Motion to approve this realty subdivision as proposed made by Tom Morrison, seconded by Kevin Rooney. All in favor; motion carried.

PB-23-03 – Spoon Exhibit Services – Subdivision & Site Plan – Preliminary & Final – Duncan Jackson, MRB Associates, presented an overview of the project & changes incorporated as a result of the sketch plan and PRC meetings. Mark Valentine of MRB then presented the revised plans. Landscaping similar to Proven Design across the street has been added, along with lighting, including three (3) additional lights in the parking lot. Storm water runoff, parking, sewer connections, elevation views of building and samples of building materials were presented. Richard LeFrois, LeFrois Builders, explained exterior walls will be split-face block (brown) & vinyl siding (birch white with bronze trim). Stucco on the front of the building will be two colors (tans) with a burgundy canopy to match the Spoon logo. Tom Morrison suggested the line of evergreens along the west property line be extended to the end of the property to shield the adjoining residences. Also, three (3) street trees are to be added to the front (similar to PDI). It was noted the hedgerow along the back line has been left to provide shielding. Additionally, Mr. Morrison had a concern about ice melt from the east side downspouts running onto the pavement & freezing during winter afternoons. These will be piped into the catch basin. Fire lanes have been corrected for length & distance from building. Lanes must be delineated & plowed during the winter months.

Long-form SEQR, Part 2, was then reviewed & discussed. Motion for negative SEQR declaration made by Mert Bartels, seconded by Tom Ferreri. All in favor; motion carried. Motion to grant preliminary & final subdivision & site plan approval for Spoon Exhibit Services made by Kevin Rooney, seconded by Brian Gagne. All in favor; motion carried.

TOWN BOARD REFERRAL:

Sapienza – 1136 Route 31 – Special Use Permit – Applicant Anthony Sapienza presented his proposal for a family & youth entertainment center at the former Breen's Market/Hoo-Ha's/Discount Golf location. He is currently leasing the building with an option to buy and has the owner's permission to pursue this special use. Mr. Sapienza has experience in the field, currently owning a nightclub in Pittsford. This venture would be a private membership club open to the surrounding school districts for teen dances & activities. Dances would occur on the weekends with other community uses during the week. Interior (22,000 sq. ft.) would include a restaurant (tables, chairs, video games) and a dance floor. A third section for a basketball court may be possible. Existing sprinklers, air conditioning and restroom facilities make this building desirable for the proposed use. Exterior cleanup of the building has already begun, along with repairs to the parking area. Adequate parking, pick-up & drop-off lanes, traffic flow, maximum occupancy, security, school/PTSA participation, number of schools and noise were all discussed. As a special use permit, this would be subject to annual review and renewal. The major concerns were traffic, parking & security; however, the Board did not see any planning issues that could not be worked out. Motion for a positive referral to the Town Board made by Brian Gagne, seconded by Kevin Rooney. All in favor; motion carried.

ZBA REFERRALS:

Z-20-03 – Lanni – 2353 Magog Rd – Area Variance – Section 135-62 Schedule I – Non-conforming lot size – Board gave a negative referral; lot should meet minimum requirements, and this is a substantial reduction in width.

Z-21-03 – Guarno – 3096 Wiedrick Rd – Area Variance – Section 135-62 Schedule I – Non-conforming lot size – Board gave a positive referral. This lot had previously been three (3) approved building lots which were combined into one. The new lots would be consistent with others in the immediate neighborhood.

Z-22-03 – Packard – Kittering Rd – Area Variance – Section 135-61-B-5 – Barn in front of house – Positive referral; no concerns.
